Title

Substitute ordinance to grant an airspace lease to Wisconsin Center District and Milwaukee City Center, LLC, for a pedestrian bridge over a portion of West Wisconsin Avenue between North 5^th and North 6^th Streets.

Analysis

This ordinance will grant an airspace lease to Wisconsin Center District and Milwaukee City Center, LLC for a pedestrian bridge over a portion of West Wisconsin Avenue between North 5^th and North 6^th Streets.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1.  FINDINGS.  In accordance with the provisions of sec. 66.0915(3), Wis. Stats., (1999-2000), the Common Council of the City of Milwaukee hereby authorizes, directs and agrees that the City of Milwaukee, through the proper city officers, enter into a lease with Wisconsin Center District and Milwaukee City Center, LLC for 99 years for the maintenance of a pedestrian bridge over West Wisconsin Avenue connecting the building known as 509 West Wisconsin Avenue and the structure known as 400 West Wisconsin Avenue, the properties being owned by Milwaukee City Center, LLC and Wisconsin Center District, respectively, with said bridge structure not to be less than 25.46 feet above the present roadway of West Wisconsin Avenue and consisting of not more than 19.74 feet in width and 18.50 feet in height, and the Common Council of the City of Milwaukee hereby finds that the area defined by the airspace lease is not needed for street, alley or other public purposes, and that the bridge will continue to serve the public interest in promoting convenient access to downtown buildings.

Part 2.  A copy of such lease is attached to the file and made part of Common Council File No. 010145.

Part 3.  All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.

Part 4.  This ordinance shall take effect and be in force from and after its passage and publication.
