This resolution authorizes a $5,000 appropriation from the Common Council Contingent Fund to the OutsideCounsel/Expert Witness Special Purpose Account for outside counsel and authorizing an agreement Whyte Hirschboeck Dudek, S.C., for the Pension Board's Indemnification Agreement.
BODY:
Whereas, The Employes' Retirement System/Annuity and Pension Board have negotiated a contract with the firm of Whyte Hirschboeck Dudek, S.C. to provide them with representation in negotiating an Indemnification Agreement with the City of Milwaukee to provide total protection to the members on any and all matters involving fulfillment of their responsibilities under law; and
 
Whereas, The City Attorney has a conflict of interest in representing the City or the Employes' Retirement System/Annuity and Pension Board in negotiating an agreement; now, therefore, be it
 
Resolved, That the sum of $5,000 be appropriated from the Common Council Contingent Fund (09-910-8000) to the Outside Counsel/Expert Witness Special Purpose Account ( 01-023-8001) and the City Attorney's Office Account (01-023-8002) for the purpose of retaining Whtye Hirschboeck Dudek, S.C. to negotiate an indemnification agreement for the Employes' Retirement System /Annuity and Pension Board; and, be it
 
Further Resolved, That the attached agreement with Whyte Hirschboeck Dudek, S.C. be approved for an amount not to exceed $5,000. Such amounts to be expended upon the presentation of invoices for service at the rate of not more than $150.00 per hour to the Office of the City, and meeting with the approval of the Office of the City Attorney.
