Substitute ordinance relating to amending the general plan of a planned development known as The Boardwalk, on the North side of West Calumet Road between North 99th Street and North 107th Street, in the 15th Aldermanic District.

This substitute ordinance will reduce the area included within the planned development so that a portion of the original development can be converted to a single-family subdivision.
BODY:
The Mayor and Common Council of the City of Milwaukee ("Common Council") do ordain as follows:
 
Part 1. There is added to the Milwaukee Code of Ordinances ("Code") a new section to read:
 
Section 295-810(2)(a).0046.      
(1) In accordance with the provisions of Section 295-810(1) of the Code relating to the establishment of planned development districts, the Common Council approves the amended general plan of a planned development known as The Boardwalk, a copy of which is attached to this Common Council File as Exhibit "A" which is on file in the Office of the City Clerk and made a part thereof as though fully set forth herein.
 
(2) The zoning map is amended to redesignate the area as a General Planned Development (GPD) located at Parcels 2 and 3 of Certified Survey Map No. 5682, being part of the Southeast 1/4 of the Northwest 1/4 of Section 17 and the Southwest 1/4 and the Northwest 1/4 of the Northeast 1/4 of Section 17, Township 08 North, Range 21 East, together with public streets adjoining, all in the City of Milwaukee, Milwaukee County, Wisconsin, more particularly bounded and described as follows:
 
Commencing at the Northwest corner of said Northeast 1/4 Section; thence South 00 deg. 10 min. 57 sec. East 876.22 feet to the point of beginning of the lands to be described; thence South 89 deg. 49 min. 04 sec. East 359.42 feet to a point; thence South 00 deg. 10 min. 56 sec. West 222.91 feet to a point; thence South 45 deg. 31 min. 15 sec. East 234.67 feet to a point on the centerline of North 99th Street; thence South 44 deg. 28 min. 45 sec. West along said centerline 397.22 feet to a point of curve; thence Southwesterly 369.49 feet along said centerline and the arc of a curve whose center lies to the Southeast, whose radius is 850.91 feet and whose chord bears South 32 deg. 02 min. 22 sec. West 366.59 feet to a point on the centerline of West Fountain Avenue; thence North 74 deg. 24 min. 00 sec. West along said centerline 152.47 feet to a point of curve; thence Westerly 126.34 feet along said centerline and the arc of a curve whose center lies to the South, whose radius is 540.00 feet and whose chord bears North 77 deg. 06 min. 09 sec. West 126.05 feet to a point; thence South 06 deg. 11 min. 43 sec. West 35.00 feet to a point on the Southerly line of West Fountain Avenue; thence Westerly 9.36 feet along said Southerly line and the arc of a curve whose center lies to the South, whose radius is 505.00 feet and whose chord bears North 84 deg. 20 min. 08 sec. West 9.36 feet to a point; thence South 32 deg. 50 min. 00 sec. West 57.86 feet to a point; thence North 77 deg. 30 min. 00 sec. West 78.23 feet to a point; thence North 12 deg. 00 min. 00 sec. West 42.00 feet to a point; thence North 69 deg. 12 min. 50 sec. West 115.40 feet to a point; thence North 89 deg. 45 min. 00 sec. West 34.40 feet to a point; thence North 23 deg. 44 min. 00 sec. East 230.89 feet to a point; thence North 22 deg. 42 min. 40 sec. West 222.65 feet to a point on the south line of the North 1/2 of said Northwest 1/4 Section; thence North 87 deg. 17 min. 20 sec. East along said south line 480.00 feet to a point on the west line of said 1/4 Section; thence North 00 deg. 10 min. 57 sec. West along said west line 447.29 feet to the point of beginning.
 
By this action, the Common Council approves the amended general plan of a planned development known as The Boardwalk and amends the zoning map to redesignate the area described above as a General Planned Development (GPD).
 
(3) The requirements set forth in said general plan attached to this Common Council File as Exhibit "A" constitute the zoning regulations for the area contained in such planned development district herein described. Provided further, that the effect of the approval of such general plan is that such plan shall limit and control construction, location, use and operation of all land and structures included within the general plan to all conditions and limitations set forth in such general plan.
 
Part 2. Any persons, firm, company or corporation owning, controlling, or managing any building or premises wherein or whereon there shall be placed or there exists anything in violation of the terms of this ordinance; or who shall build contrary to the plans or specifications submitted to and approved by the Commissioner of Building Inspection, or any person, firm, company or corporation who shall omit, neglect or refuse to do any act required in this ordinance shall be subject to the penalties provided in Section 200-19 of the Code.
 
Part 3. In accord with the provisions of Section 295-814(4) of the Code, the City Clerk shall transmit a certified copy of the action taken by the Common Council to the Department of City Development.
 
Part 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions thereof. The Common Council declares that it would have passed this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases or other portions be declared void or invalid.
