Analysis
This ordinance increases forfeitures by $10 for certain nonmoving traffic violations occurring within a commuter parking impacted area: angle parking, parking in prohibited zones (no parking, bus stops, too close to a hydrant, crosswalk or an alley) and blocking a driveway or traffic.
 
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1.  Section 101-34-2 of the code is repealed and recreated to read:
 
101-34.  Stipulation Procedure; Nonmoving Traffic Violations.
 
2.  FORFEITURE SCHEDULE.  
 
a.  The forfeiture upon stipulation under this section, except for that specified in par. b, shall be in accordance with the following schedule:
 
a-1.  Citations issued for violation of s. 101-27 except 101-27-1-a and 4: $13.
 
a-2.  Citations issued for violation of ss.101-23-4 and 6, 101-27-7-d,
101-30 and 101-33: $18.
 
a-3.  Citations issued for parking in prohibited zones, whether required to be posted or not, excluding violations of s. 101-27: $28.
 
a-4.  Citations issued for violation of ss. 101-26.5 and 101-27-4: $25.
 
a-5.  Citations issued for violation of ss. 101-23-10, 101-26 and 101-27 during a snow emergency declared under s. 101-26: $33.
 
a-6.  Citations issued for violation of ss. 101-24, 101-24.1, 101-24.2 and 101-25: $45.
 
a-7.  Citations issued for violation of s. 101-23.5: $38.
 
a-8.  Citations issued for violation of s. 101-27-1-a: $28.
 
a-9.  Citations issued for violations of s. 346.505, Wis. Stats., adopted by s. 101-3: $58.
 
a-10. Citations issued for violations of ss. 101-18 and 101-23-9: $53.
 
b.  The forfeiture upon stipulation under this section for a violation occurring within any commuter parking impacted area as described in s. 101-27.7 shall be in accordance with the following schedule:
 
b-1.  Citations issued for violations of s. 101-23- 6: $28.
 
b-2.  Citations issued for parking in prohibited zones, whether required to be posted or not, excluding s. 101-27: $38.
 
b-3.  Citations issued for violation of ss. 101-24, 101-24.1 and 101-24.2: $58.
 
Part 2.  Section 101-34-7 of the code is repealed and recreated to read:
 
7.  PENALTY.  
 
a. Any person found in violation of the provisions of this section, except for those specified in par. b, shall upon conviction be subjected to a forfeiture in accordance with the following ranges plus all taxable fees and costs for each such violation:
 
a-1. Violations of s. 101-27 except s. 101-27-1-a and 4:  $13 to $43.
 
a-2.  Violations of ss. 101-23-4 and 6, 101-27-7-d, 101-30 and 101-33:  $18 to $48.
 
a-3.  Parking in prohibited zones, whether required to be posted or not, excluding s. 101-27 of this code and s. 346.505, Wis. Stats., adopted by s. 101-3:  $28 to $48.
 
a-4.  Violations of ss. 101-26.5 and 101-27-4:  $28 to $48.
 
a-5.  Violations of ss. 101-23-10, 101-26 and 101-27 during a snow emergency declared under s. 101-26:  $33 to $53.
 
a-6.  Violations of ss. 101-24, 101-24.1, 101-24-2 and 101-25:  $48 to $68.
 
a-7.  Violations of s. 346.505, Wis. Stats., adopted by s. 101-3:  $53 to $303.
 
a-8.  Violations of s. 101-23.5:  $38 to $58.
 
a-9.  Violations of s. 101-27-1-a.:  $28 to $48.
 
a-10Violations of s. 101-18:  $53 to $73.
 
b.  Any person found in violation of the provisions of this section occurring within any commuter parking impacted area as described in s. 101-27.7 shall upon conviction be subject to a forfeiture in accordance with the following ranges plus all taxable fees and costs for each such violation:
 
b-1.  Violations of s. 101-23- 6:  $28 to $58.
 
b-2.  Violations of parking in prohibited zones, whether required to be posted or not, excluding s. 101-27 of this code and s. 346.505, Wis. Stats., adopted by s. 101-3:  $38 to $58.
 
b-3.  Violations of ss. 101-24, 101-24.1 and 101-24.2: $58 to $78.
