Title

Substitute resolution authorizing and directing the Commissioner of Public Works to execute documents titled “State/Municipal Agreement for a Highway Improvement Project” with the Wisconsin Department of Transportation for the programming and construction of various connecting highway and bridge projects with federal and/or state aid.

Analysis

This resolution authorizes and directs the Commissioner of Public Works to execute project agreements with the Wisconsin Department of Transportation (WISDOT) for the programming and construction of five (5) connecting highway projects and the rehabilitation of one bridge project including limited street enhancements with Federal/State Aid.  These projects are included in the WISDOT current, State Trunk Highway program for improvement.  The City is responsible for 25 percent of the preliminary engineering costs on these projects in accordance with WISDOT policy.  City costs for the construction of these projects will be dependent upon parking allowed.  The estimated total cost of these projects is $23,478,500, of which the City of Milwaukee’s share is $2,294,800.  The total estimated preliminary engineering cost of these projects is $2,533,500, of which the City’s share is $633,500.  This resolution also directs the City Comptroller to transfer funds for preliminary engineering for two of these projects.  Preliminary engineering funds for the other projects will be appropriated in future resolutions.

Whereas, Preliminary approval has been received from the Wisconsin Department of Transportation (WISDOT) along with agreements to be executed by the City of Milwaukee for the programming and construction or rehabilitation of the following connecting highway and bridge projects including limited street enhancements with Federal and/or State aid:

; and

 

Whereas, The improvements scheduled for these connecting highways and bridge are included on the current WISDOT State Trunk Highway Program; and

 

Whereas, South 27th Street (STH 241) West Howard Avenue to West Oklahoma Avenue, West Capitol Drive (STH 190) Bridge over Menomonee River and South Howell Avenue (STH 38) East Layton Avenue to East Howard Avenue and South Howell (STH 38) East Grange Avenue to East Layton Avenue are programmed for construction in 2010 or later; and

 

Whereas, It is the intent to appropriate preliminary engineering funds at this time for projects which will be under construction within the next few years, up to and including 2009; and

 

Whereas, Preliminary engineering funds for the other above mentioned projects will be requested in future resolutions; and

 

Whereas, Construction funds for the projects will be included in future resolutions; and

 

Whereas, The State cannot proceed with any project cost overruns and/or change in scope of more than five percent without prior the Department of Public Works' approval (DPW); and

 

Whereas, The DPW shall notify the Common Council of the City of Milwaukee at the next scheduled meeting of any such project cost overruns and/or changes in scope approved by the DPW; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100 percent liable for any such project cost overruns and/or changes in scope as approved by the DPW; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works (CPW) is hereby authorized and directed to execute agreements for the programming and construction or rehabilitation of the aforementioned connecting highway and bridge projects including limited street enhancements with Federal and/or State aid copies of which are attached to Common Council Resolution File Number 051477, and are incorporated in this resolution by reference as though set forth in full; and, be it

 

Further Resolved, That the CPW is hereby authorized and directed to undertake or engage a consultant to undertake preliminary engineering for the improvement of the aforementioned projects and to reimburse the WISDOT for preliminary engineering costs they incur for the improvement; and, be it

 

Further Resolved, That the CPW is hereby authorized and directed to enter into an agreement with the WISDOT pertaining to the cost participation for the installation and/or modification of traffic control facilities in conjunction with the improvements of the aforementioned projects; and, be it

 

Further Resolved, That the CPW is hereby authorized and directed to install the traffic control facilities necessary in conjunction with the aforementioned projects, following the execution of the traffic control agreement the cost of which will be included in future resolutions; and, be it

 

Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project/Grant Chartfield Values for preliminary engineering for the projects (Expenditures) and transfer to any of these accounts the amount required under the grant agreement and City Accounting Policy but not to exceed a 10 percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever, is greater, as follows:
