A substitute resolution relating to a memorandum of understanding relative to the Firemen and Policemen's Survivorship Fund and employees hired between January 1, 2000 and the effective date of the implementation of the global pension settlement.
ANLS:
This substitute resolution implements the global pension settlement insofar as it is concerned with the Firemen and Policemen's Survivorship Fund. Under the terms of the settlement, the Firemen and Policemen's Survivorship Fund is to close to new members as of January 1, 2000. This resolution approves a memorandum of understanding between the city, the MPA, the MPSO and Local 215, IAFF, whereby the parties agree that before new employees entering the police and fire academy can be sworn in, they will be required to execute a pre-employment agreement waiving any and all property rights that he or she may otherwise have in the Firemen and Policemen's Survivorship Fund benefits as a result of employment as a policeman or fireman of the city.
BODY:
Whereas, The State of Wisconsin established the City of Milwaukee Employes' Retirement System (MERS), a defined benefit pension plan to provide retirement benefits and other benefits to employees of the city of Milwaukee and city agencies; and
 
Whereas, The Milwaukee Police Association, Local 21, IUPA, AFL-CIO, the Milwaukee Police Supervisors' Organization and the Milwaukee Professional Fire Fighters Association, Local 215, IAFF, AFL-CIO (Unions), are certified bargaining agents under ยง 111.70, Stats., and represent police officers and fire fighters for purposes of collective bargaining; and
 
Whereas, The city and each of the unions have an agreement in principal calling for a global pension settlement under which the Firemen and Policemen's Survivorship Fund of MERS will be closed to new participants and will be dissolved effective January 1, 2000; and
 
Whereas, The aforementioned global pension settlement will require implementation through the adoption of a charter ordinance and final court approval and will therefore not become effective for an extended period of time; and
 
Whereas, The parties hereto are interested in preserving the terms of the global pension settlement agreement and have negotiated this memorandum of understanding setting forth the terms upon which the city may require the execution of a pre-employment agreement by employees hired between January 1, 2000 and the effective date of the global pension settlement agreement; now, therefore, be it
 
Resolved, By the common council of the City of Milwaukee that the memorandum of understanding and pre-employment agreement attached to the file be and hereby are approved and the City Attorney's execution of the memorandum of understanding on behalf of the city, be and hereby is ratified nunc pro tunc.
