TITL:
Resolution authorizing the appropriate City Officials to enter into a cooperation agreement with the Harley Davidson Corporation regarding street repairs and improvements in the vicinity of the company's corporate offices.
ANLS:
- ANALYSIS - This resolution approves an agreement between the City of Milwaukee and the Harley Davidson Corporation regarding repair of West Juneau Avenue between North 37th and North 38th Streets and improvements to North 38th Street between West Juneau Avenue and West Highland Boulevard. Under the terms of the agreement, Harley Davidson will contract for and manage these repairs and improvements. In addition, the company will assume most of the project costs with the City contributing an amount equal to the cost of street repairs necessitated by the West Juneau Avenue sink hole which resulted from the June 21, 1997 flood.

BODY:
Whereas, The June 21, 1997 flood ruptured a City of Milwaukee storm sewer located in West Juneau Avenue between North 37th and North 38th Streets creating a large sink hole in the public street adjacent to the Harley Davidson Company corporate offices; and

Whereas, Harley Davidson had, prior to the flood, submitted an application to the City of Milwaukee to vacate both this segment of West Juneau Avenue and the block of North 38th Street between West Highland Boulevard and West Juneau Avenue; and

Whereas, While the company still plans to pursue them, the proposed street vacations have been placed on hold pending completion of the West Juneau Avenue repair work and receipt of associated federal disaster relief aid; and

Whereas, The coordinated reports prepared in conjunction with the proposed street vacations have identified no objections to the vacation applications; and

Whereas, Harley Davidson has deposited the funds necessary to complete the street vacations; and

Whereas, Upon approval of the street vacations, Harley Davidson had intended to install certain street and sidewalk amenities at its own expense; and

Whereas, Harley Davidson would like to expedite its planned street and sidewalk improvements to ensure completion in time for the company's 95th anniversary in 1998; and

Whereas, The attached agreement allows Harley Davidson to design and contract for street and sidewalk improvements in West Juneau Avenue and North 38th Street in advance of their formal vacation; and

Whereas, The agreement provides that the City of Milwaukee will contribute an amount equal to the estimated cost of repairing the road destroyed by the sink hole with Harley Davidson funding the remainder of the improvement costs; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the appropriate City Officials are hereby authorized and directed to execute the attached cooperation agreement between the City of Milwaukee and the Harley Davidson Corporation; and, be it

Further Resolved, That the Commissioner of Public Works is authorized to issue any right-of-way permits necessary for Harley Davidson to complete the planned improvements.
