Substitute resolution releasing various deed restrictions and a fire pipe line easement for property conveyed from the City of Milwaukee to Towne Realty, Inc., in 1966 for their property now known as 105 West Michigan Street in the 4th Aldermanic District.

This substitute resolution authorizes City officials to release various deed restrictions and/or covenants in a Deed of Conveyance from the City of Milwaukee to Towne Realty, Inc., dated October 19, 1966 and recorded on November 4, 1966, Reel No. 335, Image No. 183-193 inclusive.
BODY:
Whereas, Towne Realty, Inc., in a letter dated July 16, 1997, requested that the proper City officials issue a Quit Claim Deed releasing various deed restrictions and/or covenants found in a Deed of Conveyance between the City of Milwaukee and Towne Realty, Inc., dated October 19, 1966 and recorded November 4, 1966, Reel No. 335, Image No. 183-193 inclusive, a copy of said deed is attached to this Common Council File; and
Whereas, A copy of the fire pipe line easement recorded October 23, 1929, as Document No. 1740904, is attached to this Common Council File; and
Whereas, The City Attorney's Office of the City of Milwaukee in a letter dated August 12, 1997, to the Commissioner of the Department of Public Works requested a review of the fire pipe line and other easements in the referenced deed; and
Whereas, The Department of Public Works has replied to the above referenced City Attorney's inquiry by letter dated September 5, 1997, a copy of which is attached to this Common Council File; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officials are authorized and directed to execute a Quit Claim Deed removing and/or releasing those deed restrictions and/or covenants found in the Warranty Deed dated October 19, 1966 and recorded on November 4, 1966, Reel No. 335, Image 183-193 inclusive, Document No. 4287491, between the City of Milwaukee and Towne Realty, Inc., that have expired by the passage of time (30 years) as referenced in Paragraph 11 of said Deed and/or are no longer necessary as determined by the appropriate Commissioner of the Department of Public Works/Department of City Development, City Engineer and/or Port Director; and, be it
Further Resolved, That the fire pipe line easement established by an easement recorded October 23, 1929, in Volume 1283-415 of deeds, at Page 415, as Document No. 1740904, is released and all rights of the City of Milwaukee thereunder are to be Quit Claimed to Towne Realty, Inc., under the above referenced Quit Claim Deed; and, be it
Further Resolved, That the City Attorney's Office of the City of Milwaukee shall review said Quit Claim Deed for content, form and execution prior to it being recorded in the Milwaukee County Register of Deeds Office and that the City Attorney is authorized to make any nonsubstantive changes to effect the intent of this resolution.
