Title

Substitute resolution approving the blight designation and acquisition of the privately owned properties at 1636, 1640 and 1646 North 14th Street by the Redevelopment Authority of the City of Milwaukee and authorizing subsequent conveyance to the City of Milwaukee for expansion of a Sanitation Yard, in the 15th Aldermanic District.

Analysis

Adoption of this substitute resolution by at least two-thirds vote of the Common Council of the City of Milwaukee will approve the blight designation and acquisition of the subject properties by the Redevelopment Authority of the City of Milwaukee utilizing the Spot Acquisition procedures set forth in Section 66.1333, Wisconsin Statutes, and will authorize subsequent conveyance to the City of Milwaukee.

Body

Whereas, The City of Milwaukee’s, Department of Public Works, (“DPW”) needs to expand its Sanitation Yard at 1610 North 14th Street and has requested that the Redevelopment Authority of the City of Milwaukee (“Authority”) use the blight designation and spot acquisition procedures pursuant to Section 66.1333(5)(c), Wisconsin Statutes, to acquire the privately owned properties at 1636, 1640 and 1646 North 14th Street; and

 

Whereas, Section 66.1333(5)(c)(1) of the Wisconsin Statutes enables the redevelopment authority of a first class city to acquire blighted property without designating a boundary or adopting a redevelopment plan; and

 

Whereas, Proper notice was given to all owners of record and a public hearing was conducted on February 15, 2007, by the Authority pursuant to the provisions of Section 66.1333(5)(c), Wisconsin Statutes; and

 

Whereas, After the public hearing, the Authority determined the subject properties to be blighted within the meaning of Section 66.1333(4)(bm), Wisconsin Statutes, because the present condition, access, deterioration of structures and site improvements, inappropriate use, obsolete platting and predominantly open nature substantially impair or arrest the sound growth and development of the community and of the City of Milwaukee (“City”), as summarized in a Blight Designation Summary and Land Disposition Report and a copy of which is attached to this Common Council File, and requested Common Council approval of these blight designations and acquisitions as required by Wisconsin Statutes; and

 

Whereas, After acquisition of these properties, the Authority shall convey the properties to the City for expansion of the subject Sanitation Yard; and

 

Whereas, The public hearing held on February 15, 2007, also considered the proposed property disposition as required by Wisconsin Statutes and as summarized the Blight Designation Summary and Land Disposition Report; and

 

Whereas, Funding for these acquisitions will be provided pursuant to the DPW’s Capital Account; and

 

Whereas, The City Plan Commission, which is the duly designated and acting official planning body for the City and is authorized to prepare a comprehensive plan, has reviewed and determined that these blight designations and acquisitions by the Authority and the subsequent acquisition by the City of public property conform to the general plan for the City as a whole and the Common Council has duly considered the recommendations of the planning body; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the subject spot acquisitions are approved; and, be it

 

Further Resolved, That it is found, determined and reaffirmed that:

 

1. These properties are blighted and in need of blight elimination, slum clearance and urban renewal, and qualify as eligible projects within the meaning of Section 66.1333(4)(bm), Wisconsin Statutes, as amended.

 

2. The objectives of the Authority cannot be achieved solely through rehabilitation of these projects.

 

3. These acquisitions are feasible and conform to the general plan of the City.

 

4. Funding for these acquisitions will be provided by DPW’s Capital Account; and, be it

 

Further Resolved, That to implement and facilitate the prosecution of these projects, certain official action to support the new land uses after redevelopment may be taken with general references, among other things, to changes in zoning; the vacation and removal of streets, alleys and other public ways; the location and relocation of sewer and water mains and other public facilities; and other public actions deemed necessary to effectuate the purpose of these acquisitions including the prohibition of any new construction at these properties, and accordingly, the Common Council:

 

1. Pledges its cooperation in helping to carry out these acquisitions.

 

2. Directs that no new construction shall be permitted or authorized at these properties by any agencies, boards or commissions of the City under local codes or ordinances unless as authorized by the Common Council under Section 66.1333(6)(e), Wisconsin Statutes, or by the Commissioner of Public Works.

 

3. Directs the various public officials, departments, boards and agencies of the City having administrative responsibilities in the premises likewise to cooperate to such end and to exercise their respective functions and powers in a manner consistent with the objectives for these acquisitions.

 

4. Stands ready to consider and take appropriate action upon proposals and measures designed to effectuate these acquisitions; and, be it

 

Further Resolved, That the City Clerk is directed to transmit a certified copy of this resolution to the Commissioner of the Department of Public Works, the Commissioner of the Department of Neighborhood Services, the City Engineer, the Assessment Commissioner, the Redevelopment Authority of the City of Milwaukee and to such other agencies, boards and commissions of the City having administrative jurisdiction in the premises described above; and, be it

 

Further Resolved, That upon Common Council approval, the Authority shall proceed with acquisition of these properties as provided in Section 66.1333, Wisconsin Statutes, as amended; and be it

 

Further Resolved, That the Blight Designation Summary and Land Disposition Report dated February 15, 2007, with respect to the proposed conveyance of these properties to the City, is approved.
