This resolution declares it necessary to take certain property for public street purposes for the widening of a portion of South 85th Street (east side) between West Euclid Avenue and West Ohio Avenue.
Body
Whereas, A portion of South 85th Street adjacent to Mayberry Subdivision remains undedicated and prevents the street from being opened to its ultimate width of 60.00 feet (see map attached to the file); and
 
Whereas, The City Engineer and the Commissioner of Public Works have recommended that South 85th Street is necessary to be opened and recommend the action be taken to institute Kline Law proceedings for purposes of acquiring lands for street right-of-way opening, and in particular, those lands preventing the opening of South 85th Street to its ultimate width and generally located on the east side of South 85th Street between West Euclid Avenue and West Ohio Avenue as shown of the map attached to the file ("Property"); now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that it is declared necessary to acquire that certain Property, under the procedures provided in Section 32.50 Stats., et seq. generally, those lands located on the east side of South 85th Street between West Euclid Avenue and West Ohio Avenue as shown on the map attached to the file and described as follows:
 
The west 33.00 feet of that part of (School Lands) Lot 3 in the Northwest 1/4 of Section 16, Township 6 North, Range 21 East, described as follows: Commencing at a point in the west line of South 84th Street, said point lying 45 feet west of and 572.46 feet south of the northeast corner of said 1/4 Section; thence South 88°51' West 298 feet to a point in the present east line of South 85th Street; thence Southerly, along said present east line, 52.76 feet to a point; thence Easterly 298 feet to a point in the west line of South 84th Street, said point lying 52.72 feet south of the point of commencement; thence North, along said west line, 52.72 feet to the point of commencement; and, be it
 
Further Resolved, That the Board of Assessment be required to submit a report and tentative plan of the proposed project to acquire the Property to the Common Council; and, be it
 
Further Resolved, That the City Engineer is authorized and directed to provide the necessary services that the Board of Assessment may require, such as preparation of maps, description of the property or property rights necessary for acquisition, description of adjacent properties, preparation of surveys, and estimates of costs.
