This resolution approves the sale of 0.09 acres of City-owned property located near the intersection of South 51st Street and West Puetz Road to the City of Franklin and authorizes and directs the proper City of Milwaukee officials to execute appropriate conveyance documents. This property, which is part of the Forestry Division's nursery site, is needed by the City of Franklin for completion of the West Puetz Road construction project.
 
This resolution also grants the City of Franklin a Temporary Limited Easement on 0.08 acres of City of Milwaukee-owned property in the same project area.
 
 
BODY:
Whereas, The City of Franklin needs to acquire a portion of the City of Milwaukee-owned property located at 8423 South 51st Street, Franklin, Wisconsin (Forestry Division nursery site), in order to complete the construction of West Puetz Road between Hunting Park Drive and South 76th Street (Project I.D. #2315-01-21); and
 
Whereas, The City of Franklin has offered to purchase said property, which is shown on the plan attached to and made a part of this file, in accordance with provisions of the Wisconsin Department of Transportation Real Estate Program Manual; and
 
Whereas, Negotiations between representatives of the City of Milwaukee and the City of Franklin regarding the conveyance of this property have been satisfactorily completed; and
 
Whereas, Representatives of the City of Milwaukee and the City of Franklin have also negotiated a Temporary Limited Easement for the City of Franklin on an additional 0.08 acres of City of Milwaukee-owned land in the same project area; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the following property shall be conveyed to the City of Franklin by Warranty Deed for the amount stated and other valuable consideration:
 
Parcel No. 3 - 8423 South 51st Street, Franklin, WI
 
Fee Land Acquisition - 0.09 acres
 
Total Compensation - $1,600.00 ($300 for land, $1,300 for tree and shrub replacement)
 
; and, be it
 
Further Resolved, That the City of Franklin shall also be granted a Temporary Limited Easement on 0.08 acres of City of Milwaukee-owned property in the same project area; and, be it
 
Further Resolved, That the Commissioner of Public Works of the City of Milwaukee, or the commissioner's designee, is authorized and directed to sign appropriate City of Franklin official acquisition and easement documents; and, be it
 
Further Resolved, That the proper City officials are authorized and directed to perform such acts as may be required to consummate the conveyance of the subject property; and, be it
 
Further Resolved, That the City Comptroller is authorized and directed to credit $300 of the proceeds from this sale to the City's general land sales proceeds account (account no. 01-191-9944) and $1,300 of the proceeds to the Department of Public Works-Forestry Division's supplies and materials account (account no. 01-581-6100).
