Resolution approving and authorizing the proper City officers to execute an easement agreement between the City of Milwaukee and New Covenant Housing Corporation, Inc., 3501-3511 West North Avenue to allow City conduit and a manhole to remain in place in the vacated alley located in the block bounded by West Garfield Avenue, West North Avenue, North 35^th Street and North 36^th Street, in the 15^th Aldermanic District. Analysis

New Covenant Housing Corporation, Inc., 3501-3511 West North Avenue, petitioned the City of Milwaukee to vacate the east leg of the east-west alley located in the block bounded by West Garfield Avenue, West North Avenue, North 35^th Street and North 36^th Street.  The alley vacation was approved with the adoption of Common Council Resolution File Number 021421 on May 13, 2003.  A portion of an existing communications manhole is now located within the far easterly limit of the vacated alley toward North 35th Street.  As part of the vacation conditions, the property owner has agreed to grant an easement to the City to allow the existing conduit and manhole to remain in place within the vacation limits of the alley and to allow for future maintenance and repairs of the facility.  This resolution authorizes the proper City officers to execute an easement with New Covenant Housing Corporation, Inc.

Body

Whereas, New Covenant Housing Corporation, Inc. requested that the easterly leg of the alley in the block bounded by West Garfield Avenue, West North Avenue, North 35^th Street and North 36^th Street be vacated to support their site development; and

Whereas, Said alley was vacated with the adoption of Common Council Resolution File Number 021421 on May 13, 2003; and

Whereas, A condition of said vacation was that New Covenant Housing Corporation, Inc. would grant an easement to the City to allow the existing communications conduit and manhole to remain in place and allow the City to maintain and operate said facility; and

Whereas, The terms of said easement are set out and attached to this file and approved as to content by the City Engineer and as to form by the Office of the City Attorney; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that said easement be and the same is hereby approved, and the proper City officers be and they hereby are authorized and directed to execute the same on behalf of the City of Milwaukee; and, be it

Further Resolved, That after said easement has been executed by the proper City officers, it shall be returned to the City Engineer for recording and proper distribution.
