Title
Substitute resolution relative to acceptance and funding of a 2005 Infiltration and Inflow Demonstration Partnership Project grant (Footing Drain Disconnection) and authorizing and directing the proper City Officers to execute an Intergovernmental Cooperation Agreement between the City of Milwaukee and the Milwaukee Metropolitan Sewerage District regarding the grant.
 
Analysis
This resolution authorizes the Department of Public Works to accept and fund a 2005 Infiltration and Inflow Demonstration Partnership Project grant (Footing Drain Disconnection) from the Milwaukee Metropolitan Sewerage District in the amount of $500,000.00 with a city share of $250,000.00 and a grantor share of $250,000.00. The purpose of the grant is to study infiltration and inflow caused by footing drains connected to the sanitary sewer. This resolution also authorizes and directs the proper City Officers to execute an Intergovernmental Cooperation Agreement between the City of Milwaukee and the Milwaukee Metropolitan Sewerage District regarding the project grant.
 
Body
Whereas, The City of Milwaukee (City) is eligible for grant funds from the Milwaukee Metropolitan Sewerage District (MMSD) for a study of infiltration and inflow (I/I) in footing drains that are connected to sanitary sewers; and
 
Whereas, Buildings constructed before 1954 were allowed to have their footing drains connected to the sanitary sewer; and
 
Whereas, Footing drains may allow large quantities of I/I to enter the sanitary sewer system; and
 
Whereas, The City and MMSD would like to study the effect on I/I of disconnecting the footing drains from the sanitary sewer and redirecting them to the storm sewer; and
 
Whereas, The City has submitted a proposal to MMSD in response to their Request for Proposals titled "2005 I/I Demonstration Partnerships" to study disconnecting footing drains in a single sanitary sewer system; and
 
Whereas, MMSD has adopted Resolution File ID#05-020-2 awarding the City with matching grant funds not to exceed $250,000.00 to study the effectiveness of footing drain disconnections in removing I/I from a sanitary sewer system, a copy of said resolution being attached to this file and incorporated in this resolution as though set forth in full; and
 
Whereas, The operation of this grant for the 2005 Infiltration and Inflow Demonstration Partnership Project from March, 2005 through December, 2006 is estimated to cost $500,000.00 of which $250,000.00 (50%) would be provided by the City and $250,000.00 would be provided by MMSD; and
 
Whereas, An Intergovernmental Cooperation Agreement (ICA) between the City and MMSD is required to define the scope and duration of the agreement, the project deliverables, payments and other details required to coordinate the work and complete the project as intended, a draft copy of the ICA being attached to this file and incorporated in this resolution by reference as though set forth in full; and
 
Whereas, Department of Public Works/Infrastructure Services/Sewer Maintenance has committed funds for the entire cost of the project per Common Council Resolution 041350, adopted on February 22, 2005 (SM498050001); now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the proper City officers and/or the herein named department head are hereby authorized to accept such a grant without further Common Council approval unless the terms of the grant change as indicated in Common Council File
#030712 (Grant Ordinance); and, be it
 
Further Resolved, That the City Comptroller is authorized to:
 
1. Commit funds within the Project/Grant Parent of the 2005 Special Revenue-Grant and Aid Projects and fund the following amount for the project titled, "2005 Infiltration and Inflow Demonstration Partnership (Footing Drain Disconnection)":

2. Create the necessary Grant and Aid Project/Grant and Project/Grant Levels; budget against these Project/Grant values the amount required under the grant; and, be it
 
Further Resolved, That these funds are budgeted for the Department of Public Works which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant and incur costs consistent with the grant; and, be it
 
Further Resolved, That the reimbursement amount received from MMSD be deposited in accordance with procedures established by the City Comptroller; and, be it
 
Further Resolved, That the proper City officers are authorized and directed to execute an Intergovernmental Cooperation Agreement between the City of Milwaukee and the Milwaukee Metropolitan Sewerage District regarding the 2005 Infiltration and Inflow Demonstration Partnership Project (Footing Drain Disconnection) grant; and, be it
 
Further Resolved, That the authority hereby conferred upon the City Officers and/or herein named Department head to execute the Intergovernmental Cooperation Agreement includes the authority to make and/or negotiate reasonable modifications that do not substantially change the intent of the agreement; and, be it
 
Further Resolved, That the Department of Public Works shall not spend the $250,000 of committed funds that are no longer required for this project, and that the City Comptroller is directed to effect the withdrawal of funding when the agreement for the grant is executed. The unused funding shall lapse and shall not be available for other projects.
