Title
Substitute resolution approving the Redevelopment Plan for the Menomonee Valley "K" Project Area, in the 12th Aldermanic District.
Analysis
If adopted by two-thirds vote of the Common Council membership, this substitute resolution will approve the subject Redevelopment Plan and direct City departments and agencies to work toward implementation of the Plan.
Body
Whereas, Said area was identified as Priority Area D in the Market Study, Engineering, and Land Use Plan for the Menomonee Valley; and
Whereas, The Department of City Development ("DCD") prepares analyses and land use policies for new redevelopment sites and projects; and
Whereas, On June 17, 2004, the Redevelopment Authority of the City of Milwaukee ("RACM") designated boundaries for a revised Menomonee Valley "K" Project Area ("Project Area"), which qualifies as a "blighted area" under Section 66.1333(2m)(b) Wisconsin Statutes; and
Whereas, DCD is responsible for initiating the redevelopment of blighted areas; and
Whereas, The City of Milwaukee ("City") adopted a boundary change for said Project Area (File No. 040392) on July 27, 2004; and
Whereas, The properties within said Project Area need a Redevelopment Plan to guide new economic opportunities and accomplish the goals set forth for Priority Area D; and
Whereas, RACM will convey all parcels within the Project Area boundary to a Developer for a privately owned development of a museum, office, retail and restaurant related uses, parking, an archival repository, and buildings for office and commercial use; and
Whereas, A Redevelopment Plan ("Plan") was prepared in consultation with the Developer, a copy of which is attached to this Common Council File, and is consistent with the Developer's Conceptual Plan for the project as of January 12, 2004, a copy of which is attached to this Common Council File; and
Whereas, Certain streets within said Project Area are proposed to be vacated and will be maintained and controlled by the Developer; and
Whereas, A zoning change and further land use restrictions have been prepared for this Development; and
Whereas, A public hearing was held by RACM on September 16, 2004, and property owners were noticed of this hearing and/or waived their rights to the notices; now, therefore, be it
Resolved, That the Common Council of the City of Milwaukee, approves the Redevelopment Plan for Menomonee Valley "K" Project Area; and, be it
Further Resolved, That:
1. The Plan is feasible and conforms to the general plan of the City and to the City's objectives for area development.
2. Financial assistance under Sections 66.1333(5)(4) and 66.1333(6)(f), Wisconsin Statutes, as amended, in the amount(s) necessary to enable the land in the Project Area to be renewed in accordance with the approved Plan shall be provided to RACM as authorized by future resolution(s) to be adopted by the Common Council, including, but not limited to funds provided by Tax Incremental District No. 57.
3. The City Clerk is directed to transmit a certified copy of this resolution along with all exhibits to the Commissioner of Public Works, the Commissioner of the Department of Neighborhood Services, the Commissioner of the Department of City Development and the City Engineer and to other such agencies, boards and commissions of the City having administrative jurisdiction in the Project Area.
; and, be it
Further Resolved, That the Commissioner of DCD, or designee, is authorized to convey the City-owned property within the Project Area to RACM and to execute any easements, petitions, surveys or other documents necessary to implement the project; and, be it
Further Resolved, That to implement and facilitate the prosecution of the Plan as approved, certain official actions to support new land uses in the area after redevelopment may be required and which may include the relocation of sewer and water mains, other public and private facilities, installations and any other public actions deemed necessary to carry out the Plan; and, be it
Further Resolved, That effective upon certification of the approved Plan to the Common Council; no new construction (including substantial remodeling or conversion or rebuilding, enlargement, or extension or major structural improvements on existing buildings; but not including ordinary maintenance or remodeling or changes necessary to continue occupancy) shall be permitted in said Project Area unless authorized by the Common Council, as provided in Section 66.1333(6)(e), Wisconsin Statutes; provided that new construction pursuant to the approved Plan is hereby authorized; and, be it
Further Resolved, That all City departments, boards and commissions are authorized and directed to enter into such agreements as necessary to accomplish the intent and purpose of this resolution; and, be it
Further Resolved, That City staff will provide certification of the approved Plan to the Common Council and record the approved Plan in the Office of the Register of Deeds of Milwaukee County, Milwaukee, Wisconsin.
