This resolution authorizes the entry into a Seventh Amendment to the May 23, 1994 Riverwalk Development Agreement for Business Improvement District No. 15. The Amendment is being entered into in order to increase the budget for one of the Project Segments (i.e., portions of the Wells to Kilbourn-Westside Riverwalk), with such increase to be paid for in part by special assessments against properties benefited by such Project Segment and in part by the funding and special assessment method applicable to other Project Segments (i.e., 78 percent of the cost to be borne by the City and 22 percent of the cost to be borne by the Board).
BODY:
Whereas, The City of Milwaukee ("City") and the Business Improvement District No. 15 Board ("Board") entered into a Riverwalk Development Agreement for the District dated as of May 23, 1994 (the "Development Agreement"); and
Whereas, The City and the Board entered into a First Amendment to Riverwalk Development Agreement dated as of April 3, 1995 (the "First Amendment"); and
Whereas, The City and the Board entered into a Second Amendment to Riverwalk Development Agreement dated as of June 2, 1995 (the "Second Amendment"); and
Whereas, The City and the Board entered into a Third Amendment to Riverwalk Development Agreement dated as of November 10, 1995 (the "Third Amendment"); and
Whereas, The City and the Board entered into a Fourth Amendment to Riverwalk Development Agreement dated as of May 13, 1996 (the "Fourth Amendment"); and
Whereas, The City and the Board entered into a Fifth Amendment to Riverwalk Development Agreement dated as of October 22, 1996 (the "Fifth Amendment"); and
Whereas, The City and the Board entered into a Sixth Amendment to Riverwalk Development Agreement dated as of February 28, 1997 (the "Sixth Amendment"); and
Whereas, The City and the Board desire to enter into this Seventh Amendment to the Development Agreement in order to increase the budget for one of the Project Segments (i.e., portions of the Wells to Kilbourn-Westside Riverwalk), with such increase to be paid for in part by special assessments against properties benefited by such Project Segment and in part by the funding and special assessment method applicable to other Project Segments (i.e., 78 percent of the cost to be borne by the City and 22 percent of the cost to be borne by the Board); now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officials are authorized and directed to execute the Seventh Amendment to the Riverwalk Development Agreement for Business Improvement District No. 15, a copy of which is attached to this Common Council File.
