Analysis

This ordinance will grant an airspace lease to St. Joseph Regional Medical Center, Inc. for a pedestrian bridge over a portion of North 51^st Street between West Chambers and West Burleigh Streets.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1.  FINDINGS.  In accordance with the provisions of sec. 66.0915(3), Wis. Stats., (1999-2000), the Common Council of the City of Milwaukee hereby authorizes, directs and agrees that the City of Milwaukee, through the proper city officers, enter into a lease with St. Joseph Regional Medical Center, Inc. for 99 years for the construction, use and maintenance of a pedestrian bridge over North 51^st Street connecting the hospital building known as 5000 West Chambers Street and the parking structure known as 3001 North 51^st Street, the properties being owned by St. Joseph Regional Medical Center, Inc., with the airspace not to be less than 15.5 feet above the present public rights-of-way of North 51^st Street and consisting of not more than 12.71 feet in width and 27.52 feet in height, and the Common Council of the City of Milwaukee hereby finds that the area defined by the airspace lease is not needed for street, alley or other public purposes, and that the bridge will continue to serve the public interest in promoting convenient access to essential buildings.

Part 2.  A copy of such lease is attached and made part of Common Council File No. 021504.

Part 3.  All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.

Part 4.  This ordinance shall take effect and be in force from and after its passage and publication.
