Attorney Franklin Gimble, Representative for Bell Ambulance. Motion by Ald. Puente that Exhibit (1), Comparison of Current Chapter 75-15 with File 061232, provided by Attorney Gimble be made part of the record. Prevailed. 5-0. Mr. Martin Morics, City Comptroller expressed the following concerns about Common Council File #061232 in its current version. He stated passage of the ordinance as is would impact the city negatively for the following reasons. -The city does not generally setup departmental funds that require disbursements outside of the budget. -The impact of the ordinance as currently written will take $4,000,000 of revenue out of the priority setting budget process that the Council has every year; this will allow expenditure authority to devolve to the department without budgetary review by the Council. -If the ordinance is passed and effective it could negatively impact the budget because the funds would no longer be general fund revenues. - Even though the file was submitted to address ambulance rates, the current version will damage the fiscal operations and policy making should not be done. Finally, the ordinance needs to be re-written to avoid any of the instances listed. Motion by Alderman Witkowski that the committee hold Common Council File Number 061232 again. This file was held at the January 25, 2007 Public Safety Committee meeting. At that time Alderman Witkowski requested data be provided by the Fire Department indentifying Milwaukee County's historical collection rate. Alderman Witkowski reiterated his previous request for the Fire Department to provide data identifying Milwaukee County's historical collection rate when this file is rescheduled before the Public Safety Committee.

Analysis

The Milwaukee County Association of Fire Chiefs and the Intergovernmental Cooperation Council of Milwaukee County have approved the list of billable charges that the municipalities participating in the countywide paramedic system can charge patients and their agents for advanced life support services delivered by municipally operated medical emergency dispatch vehicles. This ordinance establishes a fee schedule for patient charges for advanced life support level services and transports delivered by fire department paramedic units that operate under the countywide paramedic system agreement.

 

In addition, this ordinance permits the fire department to bill for and collect the revenues generated from the advanced life support service provisions and conveyances.

 

This ordinance also sets the amount charged for mileage at $12.00 per mile. Mileage is defined as the distance traveled with the patient in the ambulance from point of origin to destination.

Finally, this ordinance requires the fire chief to present annual status reports to the common council on all fire department advanced life support billing activities, including descriptions of the amounts invoiced, collected, and outstanding, no later than June 30 commencing June 30, 2008.

 

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Section  75-15-14-0 of the code is amended to read:

 

75-15  Ambulance Certification Regulations.

Part 2. Section  75-15-15-0 of the code is amended to read:

Part 3. Section  75-15-16-0 of the code is amended to read:

 

16. ADVANCED LIFE SUPPORT ANCILLARY CHARGES >>BILLED BY PRIVATE SECTOR PROVIDERS<<.

 

Part 4. Section 75-15-17 and 75-15-18 of the code is renumbered 75-15-18 and 75-15-19.

Part 5. Section 75-15-17 of the code is created to read:

 

17.  CHARGES FOR PATIENT SERVICES DELIVERED BY THE FIRE DEPARTMENT. The fire department shall bill for and collect all revenues generated from advanced life support conveyances and service provisions using fee schedules that have been adopted by Milwaukee County Association of Fire Chiefs and the Intergovernmental Cooperation Council of Milwaukee County and the Common Council. The rate charged for conveyance and services delivered by fire department paramedic fleet shall be as follows:

a.                     For advanced life support for patients who are residents of the Milwaukee county.

a-1.                     Paramedic non-invasive service and/or treatment without conveyance                     $75

a-2.                     Paramedic invasive service and/or treatment without conveyance                     $350

a-3.                     Paramedic service with transport Level ALS-1                                                                                    $585

a-4.                     Paramedic service with transport Level ALS-2                                                                                    $635

 

b.                     For advanced life support for patients who are not residents of the Milwaukee county.

b-1.                     Paramedic non-invasive service and/or treatment without conveyance                     $125

Items approved in Drug Group 1 are charged a rate of $25 including: Albuterol, Amidoerone (30 mg), Altropine, Benadryl, Heparin Sodium by I.V., Lasix, Lidocaine, Ativan, Versed, Sodium Chloride, Solumedrol (up to 40 mg), Terbutaline, Diazepam, Dextrose 50%, Nitro Spray SL, Normal Saline (capped), D50, and Dtw.

d-2. Items approved in Drug Group 2 are charged a rate of $30 including: Calcium Chloride, Epinephrine (I.M. or I.V., not by EPI-PEN), Dopamine, Lidocaine, and Sodium Bicarbonate.

d-3. Items approved in Drug Group 3 are charged a rate of $40 including: Morphine, Narcan and Normal Saline.

e. Mileage. In addition to the charges provided in pars. a to d, a charge of $12.00 per mile shall be assessed for mileage, mileage to be defined as the distance traveled with the patient in the ambulance from the point of patient origin to destination.

 

Part 6. Section 75-15-18 of the code is amended to read:

 

18. CONVEYANCE OF POLICE PRISONERS. Certified ambulance providers under contract with the city for payment for conveyance of police prisoners for medical treatment in situations where a prison is unable to pay for conveyance shall be paid a rate equal to 60% of the conveyance rate and mileage charge in sub. 14 and 60% of the service fees charge in sub 15. >>Charges for services rendered by the fire department under this subsection shall be paid a rate equal to 60% of all patient services delivered by the department pursuant to sub. 17.<<

 

Part 7. Section 75-20 of the code is created to read:

 

20. ANNUAL REPORT. The Fire Chief shall present annual status reports to the Common Council on all fire department advanced life support billing activities, including descriptions of the amounts invoiced, collected and outstanding, no later than June 30 commencing June 30, 2008.
