This substitute resolution authorizes the Department of City Development to enter into a Cooperation Agreement with and to accept a Grant from the Wisconsin Department of Transportation. Grant funding will be used in accordance with the referenced Terms of the Cooperation Agreement for the Fond du Lac Avenue Economic Development Plan to support economic development activities of business associations, individual businesses and property owners in the North Avenue and Fond du Lac Avenue corridors.
BODY:
Whereas, The City of Milwaukee ("City") appears to be eligible for grant funds from the Wisconsin Department of Transportation; and
 
Whereas, It would appear that City involvement in this grant and aid program would result in a major benefit to the City by supporting economic development activities of business associations, individual businesses and property owners in the North Avenue and Fond du Lac Avenue corridors; and
 
Whereas, The City's Department of Administration, Intergovernmental Relations Division, has determined that operation of this Economic Development Program from July 1, 2000 to June 30, 2003 would cost approximately $500,000, of which $500,000 or 100 percent would be provided by the Grantor; and
 
Whereas, The Local Share of this Grant program, $0 or 0 percent, will be provided from the following sources:
 
In-Kind City Share: $-0-
 
Out-of-Pocket City Share: $-0-
 
Local, Non-City Share: $-0-
 
; and
 
Whereas, The City's Department of Administration, Intergovernmental Relations Division, has determined that the benefits to the City from this Grant program appear to exceed the City's share of costs and other obligations to be incurred under this program; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that acceptance of said Grant from the Wisconsin Department of Transportation under the terms specified in the Terms of the Cooperation Agreement for the Fond du Lac Avenue Economic Development Plan, a copy of which is attached to this Common Council File, to be administered by the Department of City Development is authorized; and, be it
 
Further Resolved, That the proper City officials and/or the Commissioner of the Department of City Development are authorized to accept such Grant without further Common Council approval unless any of the following occur:
 
1. The purpose of such Grant program changes significantly.
 
2. The amount of the Out-of-Pocket City Share increases from the amount specified above; and, be it
 
Further Resolved, That the City Comptroller is authorized to:
 
1. Commit funds within the Project/Grant Parent of the 2000 Special Revenue Grant and Aid Projects Fund, the following amounts for the program titled Fond du Lac Avenue Economic Development Plan Program Grant:

2. Create the necessary Project and Project Level Values and budgets to these project values, the amounts required under the Grant Agreement.

Further Resolved, That these funds are budgeted for the Department of City Development which is authorized to expend from the amount budgeted for specified purposes as indicated in the Terms of the Cooperation Agreement for the Fond du Lac Avenue Economic Development Plan and incur costs consistent with the award date; and, be it
 
Further Resolved, That the funds received from the Wisconsin Department of Transportation be deposited in accordance with procedures established by the City Comptroller; and, be it
 
Further Resolved, That the Commissioner of the Department of City Development shall have the authority to authorize transfers within the program budget as long as the amount expended for any purpose shall not exceed the amount authorized by the budget by 10 percent and such transfers are in accordance with Grantor regulations; and, be it
 
Further Resolved, That the Commissioner of the Department of City Development, on behalf of the City, is authorized to enter into a Cooperation Agreement and any subcontracts as described in the Terms of the Cooperation Agreement for the Fond du Lac Avenue Economic Development Plan and in accordance with City purchasing procedures and Grant and Aid Guidelines for awarding such contracts.
