Resolution approving the settlement of the lawsuit entitled Royce Redell Flowers Nash II v. City of Milwaukee, et al., E.D. Wisc. Case No. 21-CV-101, and appropriating up to $400,000 from the Common Council Contingent Fund for this purpose.

This resolution authorizes settlement of claims raised by the Plaintiff Royce Redell Flowers Nash II in the lawsuit entitled Royce Redell Flowers Nash II v. City of Milwaukee, et al., E.D. Wisc. Case No. 21-CV-101, in the amount of $400,000.

Whereas, Plaintiff Royce Redell Flowers Nash II filed a lawsuit in the Eastern District of Wisconsin, Case No. 21-CV-101, against City of Milwaukee and Maria Monteagudo, seeking damages for alleged violation of Title VII of the Civil Rights Act of 1964, as amended, and 42 U.S.C. §§ 1981 and 1983; and
Whereas, Plaintiffs have agreed to settle the claims raised in the above-referenced lawsuit for the total amount of $400,000, inclusive of all costs and fees, including attorney’s fees; and
Whereas, The City Attorney recommends and deems it expeditious and just to settle this lawsuit; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the City Attorney is authorized to settle the case entitled Royce Redell Flowers Nash II v. City of Milwaukee, et al., E.D. Wisc. Case No. 21-CV-101, for the amount of $400,000; and be it
Further Resolved, By the Common Council of the City of Milwaukee, that up to $400,000 from the 2022 Common Council Contingent Fund (0001-9990-C001-006300) is reserved and appropriated to the 2022 Damages & Claims Fund (0001-1490-S118-006300); and be it
Further Resolved, That those funds are to be utilized to issue the following checks to be mailed to 124 W. Broadway, Monona, WI 537166, attention Peter Fox, in compliance with the settlement agreement:
(1) $250,000 payable to Royce Redell Flowers Nash II
(2) $150,000 payable to Fox & Fox, S.C.,
as soon as practicable; and, be it
Further Resolved, That for and in consideration of this payment, the plaintiff, by their representatives and their attorneys, will provide to the City a release of any claims arising out of or in any way related to this incident.
