Resolution authorizing the execution of a stipulation between the City of Milwaukee, the Wisconsin Department of Transportation and the Union Pacific Railroad Company for the reconstruction and maintenance of the South 29^th Street Overpass structure of the Union Pacific Railroad tracks between West Montana Street and West Cleveland Avenue in the City of Milwaukee.

Analysis

This resolution will authorize the execution of a stipulation with the Wisconsin Department of Transportation and the Union Pacific Railroad Company for the reconstruction and maintenance of the South 29^th Street Overpass of the railroad tracks between West Montana Street and West Cleveland Avenue.

Body

Whereas, The Common Council of the City of Milwaukee adopted Resolution File Number 060171 on June 20, 2006 directing the Commissioner of Public Works to execute a program agreement with the Wisconsin Department of Transportation (WISDOT) for programming the reconstruction of the South 29^th Street Overpass structure of the Union Pacific Railroad Company with Federal and/or State Aid funds under the Bridge Replacement Program; and

Whereas, Negotiations have taken place between the Union Pacific Railroad Company and WISDOT, acting on behalf of the City of Milwaukee, to negotiate a stipulation regarding the reconstruction and maintenance of the overpass; and

Whereas, The Union Pacific Railroad Company has forwarded the stipulation document to the City of Milwaukee for formal approval and upon execution, the City of Milwaukee will forward the stipulation document to the WISDOT for their execution; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the stipulation between the City of Milwaukee, the WISDOT and the Union Pacific Railroad Company, for the reconstruction and maintenance of the South 29^th Street Overpass structure of the South 29^th Street Bridge over the Union Pacific Railroad tracks between West Montana Street and West Cleveland Avenue is hereby approved, a copy of which is attached to Common Council Resolution File Number 061316 and incorporated in this resolution by reference as though set forth therein in full; and, be it

Further Resolved, That the proper City officials are hereby authorized and directed to execute said stipulation.
