Title
Resolution authorizing dedication of a portion of City-owned property as public right-of-way for street purposes, approving a Land Disposition Report and surplus declaration for the conveyance of a portion of City-owned property to Milwaukee County and accepting an easement from Milwaukee County for the Lakefront Gateway project, in the 4th Aldermanic District.
Analysis
This resolution authorizes the City of Milwaukee to execute the necessary documents to dedicate land for public right-of-way, convey property to Milwaukee County according to the conditions in a Land Disposition Report and accept an easement from Milwaukee County to finalize a Certified Survey Map that is necessary for the Lakefront Gateway project.
Body
Whereas, The City of Milwaukee (“City”) and Milwaukee County (“County”) have created a Certified Survey Map (“CSM”) to resolve longstanding public right-of-way and property line issues associated with the Lakefront Gateway project, as shown in Exhibit A, a copy of which is attached to this Common Council File; and
Whereas, A portion of City-owned land must be dedicated as East Michigan Street (“Dedication Property”) before the CSM can be recorded; and
Whereas, The legal description of the Dedication Property to be dedicated is as follows and is illustrated in Exhibit B, a copy of which is attached to this Common Council File:
That part of Accrued Lands in the Southeast 1/4 of Section 28, Township 7 North, Range 22 East, described as follows: Commencing at the southwest corner of said 1/4 Section; thence North 1°02’02” West, along the west line of said 1/4 Section, 2327.41 feet to a point; thence South 37°30’43” East 6.08 feet to a point; thence South 77°45’59” East 76.99 feet to a point; thence South 74°43’04” East 70.09 feet to the point of beginning of the land to be described; thence continuing South 74°43’04” East 109.17 feet to a point of curve; thence Southeasterly, 47.08 feet along the arc of said curve, which has a radius of 250.00 feet, with its center lying to the northeast having a central angle of 10°47’27” and whose chord bears South 80°06’48.5” East, 47.01 feet to a point of compound curve; thence Easterly, 208.82 feet along the arc of said curve, which has a radius of 1469.00 feet, with its center lying to the north having a central angle of 8°08’40” and whose chord bears South 89°34’52” East, 208.64 feet to a point of tangency; thence North 86°20’48” East 83.62 feet to a point; thence North 84°22’28” East 81.70 feet to a point; thence South 5°44’43” East 61.93 feet to a point; thence South 84°21’19” West 270.40 feet to a point; thence North 5°52’31” West 4.35 feet to a point of curve; thence Northwesterly, 5.85 feet along the arc of said curve, which has a radius of 4.00 feet, with its center lying to the southwest having a central angle of 83°47’27” and whose chord bears North 47°46’14.5” West, 5.34 feet to a point of reverse curve; thence Northwesterly, 100.46 feet along the arc of said curve, which has a radius of 1533.00 feet, with its center lying to the north having a central angle of 3°45’17” and whose chord bears North 87°47’19.5” West, 100.44 feet to a point of tangency; thence North 85°54’41” West 61.91 feet to a point of curve; thence Northwesterly, 14.40 feet along the arc of said curve, which has a radius of 200.00 feet, with its center lying to the north having a central angle of 4°07’32” and whose chord bears North 83°50’55” West, 14.40 feet to a point of tangency; thence North 81°47’09” West 110.82 feet to a point on a curve; thence Northeasterly, 84.59 feet along the arc of said curve, which has a radius of 1469.39 feet, with its center lying to the northwest having a central angle of 3°17’54” and whose chord bears North 19°37’20” East, 84.58 feet to the point of beginning; and
Whereas, In order for property lines to be consistent with as-built improvements and current use, a portion of City-owned property must be transferred to the County (“City Property”), as summarized in a Land Disposition Report and a Due Diligence Checklist, copies of which are attached to this Common Council File; and
Whereas, Section 304-49-8 of the Milwaukee Code of Ordinances allows the City to convey land to designated persons or entities for adequate fair market consideration, which may recognize monetary as well as non-monetary consideration; and
Whereas, The Department of City Development has reviewed the proposed conveyance and has determined that the offered consideration represents fair compensation to the City; and
Whereas, The Dedication Property and City Property are under the jurisdiction of the Port of Milwaukee, and the Board of Harbor Commissioners has approved the dedication of the Dedication Property and the conveyance of the City Property; and
Whereas, The City Plan Commission has approved the dedication of the Dedication Property as public right-of-way and the surplus to municipal needs declaration and conveyance of the City Property; and
Whereas, In exchange for the City Property, the County wishes to grant the City an easement for a portion of property currently used as North Harbor Drive and a public walkway (“County Easement”), as shown in Exhibit C, a copy of which is attached to this Common Council File; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of City Development (“DCD”), or designee, is authorized to execute a deed on behalf of the City to dedicate the Dedication Property as public right-of-way; and, be it
Further Resolved, That the City Property is declared surplus to municipal needs and its conveyance to Milwaukee County is approved; and, be it
Further Resolved, That the City is authorized to accept the County Easement from the County; and, be it
Further Resolved, That the proper City officials are directed to execute any additional documents and instruments and to perform such acts, as necessary, to carry out the purposes of this resolution.
