Title
Substitute resolution to vacate the right-turn bypass located at the Northeast corner of North Humboldt Avenue and East Kane Place and unimproved North Astor Street between North Water Street and the Milwaukee River, in the 3rd Aldermanic District.
Analysis
This substitute resolution vacates the above right-turn bypass and unimproved portion of street in accordance with vacation proceedings under power granted to the City of Milwaukee by Section 66.297(1), Wisconsin Statutes, and Section 81-308-28, Milwaukee Code of Ordinances. This vacation was requested by the Redevelopment Authority of the City of Milwaukee for consolidation of land for future sale and development of a residential condominium building.
Body
Whereas, It is proposed that the right-turn bypass located at the Northeast corner of North Humboldt Avenue and East Kane Place and unimproved North Astor Street between North Water Street and the Milwaukee River, be vacated pursuant to the provisions of Section 66.297, Wisconsin Statutes; and
Whereas, The Department of Public Works has been authorized and directed to prepare a coordinated report estimating all costs and benefit assessments that will be incurred with said vacation; and
Whereas, Said vacation has been reviewed in accordance with Section 81-308-28, Milwaukee Code of Ordinances; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that said right-turn bypass and unimproved portion of street, as indicated by Exhibit A and bound and described by:
Right-turn bypass: That part of public street right-of-way at the northwest corner of North Humboldt Avenue and North Water Street in the Northwest 1/4 of Section 21, Township 7 North, Range 22 East, described as follows: Commencing at the southeast corner of Water Lot 1, as originally platted, in Hubbard and Pearson's Addition, a recorded subdivision, in said 1/4 Section; thence Southwesterly, along the southerly line of Water Lot 1, as originally platted, 50.00 feet to a point; thence Northeasterly 72.54 feet to a point in the east line of Water Lot 1, as originally platted, said point lying 50.00 feet north of said southeast corner of Water Lot 1; thence South, along said east line, 50.00 feet to the point of commencement.
Portion of North Astor Street: All that part of North Astor Street in the Northwest 1/4 of Section 21, Township 7 North, Range 22 East, lying between the northerly line of North Water Street, extended, and the dock line of the left bank of the Milwaukee River, established per Ordinance No. 16, File No. 73-2311, adopted on April 30, 1974, is vacated; and, be it
Further Resolved, That upon deposit of the funds required, the Commissioner of Public Works and/or the City Engineer are authorized to implement actions listed in the coordinated report relating to said vacation; and, be it
Further Resolved, That as provided by Section 80.32(4), Wisconsin Statutes, said vacation shall not terminate the easements and rights incidental thereto acquired by or belonging to any county, town, village or city, or to any utility or person in any underground structures, improvements or services, as enumerated or otherwise existing in said description of land above described, both easements and rights and all rights of entrance, maintenance, construction and repair with reference thereto shall continue as if said right-turn bypass and unimproved street had not been vacated.
