Title

Substitute resolution relating to use of the state of Wisconsin Tax Refund Interception Program for unpaid parking tickets.

 

Analysis

The Wisconsin Department of Revenue’s Tax Refund Intercept Program permits municipalities to intercept tax refunds to collect monies owed for unpaid parking tickets for those persons who have outstanding balances of at least $20. Currently, the Parking Fund certifies all persons with unpaid parking ticket balances of over $75 with the Wisconsin Department of Revenue. This resolution directs the Commissioner of Public Works to certify parking ticket debts in the Tax Refund Intercept Program for those persons whose balances are over $45.

 

Body

Whereas, Under s. 71.935, Wis. Stats., the Wisconsin Department of Revenue (DOR) is permitted to intercept, or set off, taxpayer refunds and other refundable credits against certain county or municipality debts; and

 

Whereas, All debts certified with the DOR’s Tax Refund Intercept Program (TRIP) must be identified by the debtor's name and social security number, federal identification number or operator’s license number, and must have a balance of at least $20; and

 

Whereas, The Department of Public Works’ Parking Fund began its participation in TRIP in 2002 by certifying those persons whose balances for unpaid parking tickets were over $300; and

 

Whereas, A person’s outstanding balance before a TRIP certification took place was administratively reduced by the Parking Fund’s staff to balances over $100 in 2003 and further reduced in 2006 to balances over $75; and

 

Whereas, The Department of Public Works’ Parking Fund currently certifies persons whose outstanding balances for unpaid parking tickets are over $75 and have been outstanding for more than 80 days;

 

Whereas, The amount of annual revenue DPW Parking Fund received from TRIP has increased from approximately $1.2 million in 2002 to approximately $2.6 million in 2006, thereby totaling approximately $6.9 million by the end of 2006 through the utilization of TRIP; and

 

 

Whereas, Increasing the amount of revenue the Parking Fund receives from TRIP by reducing the balance before a TRIP certification takes place to $45 would benefit the Parking Fund and the City of Milwaukee; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is directed to certify parking ticket debts in the TRIP program for those persons whose balances are over $45 and are greater than 90 days old.
