City of Milwaukee, Case No. 97-CV-0009822.

BODY

Whereas, FN 960765 adopted on 1/17/97 appropriated $10,000 from the Outside Counsel/Expert Witness Fund Special Purpose Account for the purpose of hiring outside counsel Friebert, Finerty & St. John, S.C. to represent the City in Policemen's Annuity & Benefit Fund v. City of Milwaukee, Case No. 97-CV-0009822; and

Whereas, The entire amount of funding in the Outside Counsel/Expert Witness Fund Special Purpose Account has been appropriated for various cases and additional funding from the Contingent Fund is necessary; and

Whereas, Billings by Friebert, Finerty & St. John, S.C., through August, total $16,616.15 and there is a negative balance of $6,616.15 of the original $10,000 appropriation; now, therefore, be it

Resolved, That the sum of $10,000 be appropriated from the Common Council Contingent Fund (09-910-8000) to the Outside Counsel/Expert Witness Fund Special Purpose Account (01-023-8001) and to the City Attorney's Office Account (01-023-8002) for the purpose of paying the legal fees of Friebert, Finerty & St. John, S.C. in Policemen's Annuity & Benefit Fund v. City of Milwaukee, Case No. 97-CV-0009822; and, be it

Further Resolved, That all charges be approved by the City Attorney's Office upon the presentation of invoices for services at a rate not to exceed $110 per hour; and that the application of the funds appropriated herein to a case other than that specifically referred to herein shall be subject to the further direction of the Common Council.
