Resolution granting permission to the Milwaukee Metropolitan Sewerage District to place and/or maintain a generator with a masonry enclosure at the south side of West Villard Avenue, east of North 27th Street, in the 1st Aldermanic District in the City of Milwaukee. (Infrastructure Services Division)
Analysis
This resolution authorizes and directs the Commissioner of Public Works to now issue all necessary permits to the Milwaukee Metropolitan Sewerage District for the installation of a masonry enclosure around an in-place generator which was originally intended to be for temporary backup power for potential Y2K problems, but now will become permanent, at the south side of West Villard Avenue, east of North 27th Street.
Body
Whereas, The Milwaukee Metropolitan Sewerage District (MMSD) was granted a permit to temporarily place a generator in the public right-of-way in the sidewalk area at the south side of West Villard Avenue, east of North 27th Street adjacent to Lincoln Creek Parkway, as backup power in case of potential Y2K problems; and
 
Whereas, MMSD now wishes to leave the generator in place as a permanent installation; and
 
Whereas, The generator, which is currently surrounded by a chain link fence, has been deemed aesthetically unacceptable as is and will, therefore, have an 8-foot high masonry wall constructed around it to hide it from public view; and
 
Whereas, The generator and masonry wall may only permanently occupy the public right-of-way with Common Council approval; now, therefore, be it
 
Resolved, That the Commissioner of Public Works is authorized to issue a permit to the MMSD for the construction of a masonry enclosure for a generator located within the public right-of-way of West Villard Avenue, east of North 27th Street; and, be it
 
Further Resolved, That the MMSD is hereby granted the following special permission:
 
To maintain an existing generator within a masonry enclosure that will be used for backup power for MMSD facilities.  This generator with masonry enclosure is located in the public right-of-way in the south sidewalk area of West Villard Avenue, east of North 27th Street, approximately 14 feet east of the east curbline of North 27th Street.
 
Said generator and masonry wall shall be disassembled and the affected area returned to its original and satisfactory condition when no longer needed. The items indicated above shall be constructed, used and maintained to the satisfaction of the Departments of Public Works and Neighborhood Services and all necessary permits shall be obtained from the Departments of Public Works and Neighborhood Services; and, be it
 
Further Resolved, That this permission is granted only on condition that the MMSD shall:
 
1.  Hold the City of Milwaukee or its agents harmless and accept responsibility for any and all liabilities that may arise through implementation of the permission granted herein.
 
2.  Obtain the necessary Department of Public Works permit prior to construction of the masonry wall and any other related items within the right-of-way.
 
3.  Whenever the generator or masonry wall are no longer needed or when so ordered, not only remove these items but shall also restore to its former condition and to the approval of the Commissioner of Public Works any public improvement which was removed, changed or disturbed by reason of the granting of this resolution.  Grantee shall not be entitled to any damages for such removal.
