This Resolution authorizes the City to enter various agreements relating to storm water management for, and construction activities at, Westlawn Gardens, in the 2^nd aldermanic district.

Whereas, Westlawn Gardens is generally situated to the south of West Silver Spring Drive between North 60^th Street and North 68^th Street, and the Housing Authority of the City of Milwaukee (HACM) is undertaking redevelopment of the western portion of Westlawn Gardens; and

Whereas, in conjunction with HACM’s redevelopment activities, HACM and the City’s Department of Public Works (DPW), with assistance from the City Attorney’s Office, negotiated various agreements that are part of this file and that pertain to HACM’s redevelopment and to storm water management for, and construction activities at, Westlawn Gardens, to wit: (1) a Storm Water Management Facility and Mews Maintenance and Easement Agreement; (2) an Out of Program Agreement; (3) an Interim Easement; and (4) an Access Easement; and

Whereas, HACM will coordinate the creation of an association per a Declaration to undertake various ownership rights and maintenance responsibilities as required in the negotiated documents; and

Whereas, pursuant to the documents, HACM will undertake construction of various public improvements and private improvements at the western portion of Westlawn Gardens, an owners’ association will be responsible for maintenance of outlot common areas and storm water management facilities for overall storm water management for the entirety of Westlawn Gardens, and certain easements will be created to allow for the construction and maintenance and for public use and access; and

Whereas, the documents coincide with a subdivision plat for the western portion of Westlawn Gardens that DPW and HACM are or will be submitting for approval to the Council; now, therefore, be it

Resolved, by the Common Council of the City of Milwaukee that, the documents that are part of this file are hereby approved, and the Commissioner of Public Works is authorized to enter into the Out of Program Agreement, the Interim Easement, and the Storm Water Management Facility and Mews Maintenance and Easement Agreement, in form and substance of such documents that are part of this file, or in substantially conformance therewith; and be it

Further Resolved, that the Commissioner of Public Works is hereby authorized to take such further actions as shall be necessary to carry out the intent of this resolution and those documents.
