Title

Substitute resolution granting a permanent limited easement to We Energies for a portion of the City-owned property at 841 North James Lovell Street for the Wisconsin Department of Transportation Kilbourn Tunnel Lighting Project (4th Aldermanic District).

Analysis

This resolution grants a permanent limited easement to We Energies to accommodate the Wisconsin Department of Transportation Kilbourn Tunnel Lighting Project. 

Body

Whereas, The Wisconsin Department of Transportation is replacing the lighting system in the Kilbourn Tunnel and has requested We Energies acquire easement rights from the City of Milwaukee to facilitate the work; and

 

Whereas, Land needed for the improvements are part of 841 North James Lovell Street, which is owned by the City and managed as an undevelopable vacant parcel by the Department of Public Works (“DPW”); and

 

Whereas, The City and DPW will benefit from this project, since the new conduit will draw electricity from the east and North 6th Street rather than the parking deck owned by the City to the west; and

 

Whereas, We Energies is requesting the acquisition of property rights at 841 North James Lovell Street consisting of approximately 1,400 square feet of the undeveloped site as a Permanent Limited Easement for an underground utility line to improve lighting in the Kilbourn Tunnel and as indicated in this Common Council file; and

 

Whereas, We Energies presented the City as the fee owner with an offer for the permanent limited easement; and

 

Whereas, The offer presented by We Energies has been reviewed by the City Real Estate staff and a negotiated settlement has been reached between We Energies and the City to acquire easement rights, in the total amount of $1,000; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of City Development, or designee, is authorized to execute the easement, and other documents necessary to grant the permanent limited easement to We Energies, and to take such further acts as are or may be necessary to effectuate this resolution; and, be it

 

Further Resolved, That the compensation for the permanent limited easement of $1,000 shall be deposited with the City as the caretaker of the property at 841 North James Lovell Street.
