This resolution authorizes cancellation of $4,043.71 of the City of Milwaukee's subrogation claim against Bonita Jankowski, for payments made pursuant to the City's Basic Health Plan. _____________________________________________
BODY:
Whereas, Bonita Jankowski has commenced a lawsuit against Christine Hawkins and Badger Mutual Insurance Company, alleging a personal injury claim arising out of injuries allegedly sustained in an automobile collision on November 23, 1993; and
Whereas, As a result of injuries allegedly sustained as a result of that accident, the City of Milwaukee has made payments on behalf of Bonita Jankowski for treatment of such injuries pursuant to its Basic Health Plan in the amount of $5,543.71; and
Whereas, The City of Milwaukee has a subrogation claim gainst Bonita Jankowski as a result of such payments; and
Whereas, The parties have agreed to settle this claim for $1,500, and the difference between the original claim and the settlement is $4.043.71; and
Whereas, This settlement reflects the legal liability of the parties and is a fair and equitable resolution of the City of Milwaukee's subrogation claim; now therefore be it
Resolved, By the Common Council of the City of Milwaukee, that the subrogation claim of the City of Milwaukee against Bonita Jankowski arising out of payments for treatment of injuries allegedly sustained as a result of her personal injury action filed against Christine Hawkins and Badger Mutual Insurance Company in Milwaukee County Circuit Court, Case No. 96-CV-008766, is hereby cancelled in the amount of $4,043.71.
