This resolution declares the vacant, tax deed lots located at 611 (part), 617 and 619 North 29th Street surplus to City needs. It further authorizes and directs the sale of these lots to the owner of an adjoining property, Jeanette Gibbs, for $1.00 subject to certain conditions.
 
 
BODY:
Whereas, Jeanette Gibbs, owner of the property located at 618 North 30th Street, has offered to purchase the adjoining vacant, tax deed lots located at 611 (part), 617 and 619 North 29th Street (tax roll key nos. 401-1608-100-X (part), 401-1609-100-5 and 401-1610-100-0, respectively), said lots containing a combined total area of 5,600 square feet, from the City of Milwaukee for $1.00 for use as green space; and
 
Whereas, The City Plan Commission has approved the acceptance of said offer, with the sale of the lots to be consummated in the manner provided for the sale of tax deed lots pursuant to s. 304-49 of the Milwaukee Code of Ordinances; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the vacant, tax deed lots located at 611 (part), 617 and 619 North 29th Street (tax key nos. 401-1608-100-X (part), 401-1609-100-5 and 401-1610-100-0, respectively) are declared surplus to City needs; and, be it
 
Further Resolved, That the offer to purchase said lots for $1.00 received from an adjoining property owner, Jeanette Gibbs, is accepted; and, be it
 
Further Resolved, That the proper City officials are authorized and directed to perform such acts as may be required to consummate the sale of said lots to Jeanette Gibbs; and, be it
 
Further Resolved, That the sale of said lots shall be contingent upon the following conditions:
 
1. The lots are being sold in an "as is" condition.
 
2. The buyer shall submit a site plan, including landscaping, paved parking, fencing and other intended improvements, along with a timeline for completing such improvements, to the Department of City Development for review and approval prior to closing of the sale.
 
3. Following site plan approval, the buyer shall submit to the City a performance bond, irrevocable letter of credit or certified or cashier's check in the amount of $2,500 to ensure the improvements are completed in accordance with the approved site plan and time line. In the event the buyer fails to perform as agreed, the City may call on the bond, letter of credit or other deposit to complete the proposed work.

Further Resolved, That the proceeds from this sale shall be credited to the Reserve for Tax Deficit Fund (account no. 02-211-2700).
