Title

Resolution relative to a request from the City of Wauwatosa to amend their water service agreement with the City of Milwaukee to allow Wauwatosa to provide water service to the Village of Elm Grove.

Analysis

This resolution authorizes the Milwaukee Water Works to conduct an engineering feasibility study, and Legislative Reference Bureau to conduct an analytical study, regarding the provision of additional water to the City of Wauwatosa for the purpose of Wauwatosa providing that water to the Village of Elm Grove.  When completed, those feasibility reports will be submitted to the Council with a resolution seeking authority to amend the water services agreement between the City of Milwaukee and the City of Wauwatosa to enlarge the service area to include the Village of Elm Grove.

Body

Whereas, The Village of Elm Grove has requested that the Wauwatosa Water Utility extend its water service area to include the Village of Elm Grove; and

Whereas, The City of Wauwatosa receives water from Milwaukee under the terms of an “Agreement Between the City of Milwaukee and the City of Wauwatosa for the Purchase of Water at Wholesale” which was made on December 10, 2003; and

Whereas, That water service agreement defines the area to be served with water as the municipal limits of Wauwatosa and requires that no water may be resold outside that service area without the permission of Milwaukee; and

Whereas, The City of Wauwatosa has adopted a resolution requesting that Milwaukee evaluate the feasibility of providing additional water to Wauwatosa for this purpose and, if feasible, to amend the existing contract between Wauwatosa and Milwaukee to extend the service area to include the Village of Elm Grove; and

Whereas, Resolution File No. 980871 adopted by the Milwaukee Common Council on April 20, 1999 requires the Legislative Reference Bureau to conduct an analytical study of the proposed water sale and requires the Water Works to submit a written evaluation of the proposed water sale identifying relevant data for the Council’s consideration; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Water Works and the Legislative Reference Bureau are hereby authorized to study and evaluate the water service request from the City of Wauwatosa; and, be it

Further Resolved, That the resulting feasibility reports will be submitted to the Common Council and the Mayor with a resolution for Council consideration seeking authority to amend the water services agreement between the City of Milwaukee and the City of Wauwatosa to enlarge the service area to include the Village of Elm Grove.
