Substitute Resolution relative to the application, acceptance and funding of a Wisconsin Department of Transportation Harbor Assistance Grant Project for the Port of Milwaukee in connection with road and rail crossing rehabilitation on East Scott Street and Lincoln Memorial Drive.

BODY:

Whereas, The Wisconsin Department of Transportation, in accordance with State Statute, requires a Statement of Project Intentions from local units of government intending to apply for Federal and/or State aid for harbor related work of benefit to commercial transportation within the next three years; and

 

Whereas, The Common Council of the City of Milwaukee approved the Three-Year Harbor Development Statement of Intentions for the Port of Milwaukee for 1999-2001 through adoption of Resolution File Number 971719 on March 16, 1998; and

 

Whereas, Such Statement of Intentions, which includes the aforementioned project was transmitted to the Wisconsin Department of Transportation; and

 

Whereas, Such Statement of Intentions includes Road and Rail Crossing Rehabilitation on East Scott Street and Lincoln Memorial Drive as a 1999 project; and

 

Whereas, The Port of Milwaukee desires to make application with the State of Wisconsin for Harbor Assistance Program aid, and

 

Whereas, The aforementioned project will be administered by the Department of Public Works; and

 

Whereas, Mr. Mariano A. Schifalacqua, City Engineer, will be the contact person for the project and is authorized to sign forms and claims; and

 

Whereas, The City of Milwaukee will accept responsibility for the maintenance of the proposed project after completion; and

 

Whereas, The aforementioned project is consistent with the Port of Milwaukee Harbor Development Plan; and

 

Whereas, The total project cost of $950,000 will be funded 80% through the State of Wisconsin Harbor Assistance Program through the Grantor Share Parent Account (32-010-0000) and 20% through the City's 1998 State and/or Federal Aid - Major Street Improvement Program (32-550-0001); and

 

Whereas, The Department of Public Works has indicated that the City's share is included in the 1998 program; and

 

Whereas, The City of Milwaukee agrees to provide the Wisconsin Department of Transportation, in a timely manner, additional analysis or documentation supporting the application, whenever the Department considers it necessary during the application review process; and

 

Whereas, The City of Milwaukee agrees to provide required matching funds up to the stated maximum at the time and in the manner specified in the agreement; and

 

Whereas, Mr. Mariano A. Schifalacqua, City Engineer, will undertake the necessary steps to obtain Common Council authority to establish appropriate accounts within the Department of Public Works; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that The Port of Milwaukee is authorized to make application with the State of Wisconsin Department of Transportation for State aid for harbor related work in connection with road and rail crossing rehabilitation on East Scott Street and Lincoln Memorial Drive and, be it

 

Further Resolved, That the proper City Officials and/or the Municipal Port Director are hereby authorized to accept the aforementioned Grant without further Common Council approval unless:

 

1. The purpose of such grant project is significantly changed; or

 

2. The amount of the Out-of-Pocket City share increases from that specified above; or

 

3. The ratio of Out-of-Pocket City share to Grantor's share increases from that specified above; and, be it

 

Further Resolved, That the City Comptroller is authorized to encumber in the parent account of the 1998 Capital-Grant and Aids Project, the following amounts for the program/project titled Road and Rail Crossing Rehibilitation on East Scott Street and Lincoln Memorial Drive:

 

Account Number Account Amount 32-010-0000 Grantor Share $760,000 32-550-0001 Major Street Improvements 190,000

 

;and, be it

 

Further Resolved, That the City Engineer is authorized and directed to seek Common Council authority to establish the necessary accounts and to transfer funds encumbered under Common Council Resolution 980355 for the project; and, be it

 

Further Resolved, That the City Comptroller is authorized and directed to establish said accounts with the specified appropriations following adoption of the above resolution.
