Title
Substitute Resolution approving the plat of right-of-way and relocations orders required for the construction of North 124th Street from West Ruby Avenue to West Hampton Avenue (portions in the City of Wauwatosa).
Analysis
This resolution approves the plat of right-of-way required for the improvement of North 124th Street from West Ruby Avenue to West Hampton Avenue (portions in the City of Wauwatosa), authorizes the City to participate in acquiring lands or interests in lands as shown on the plat of right-of-way required for the project and authorizes the City Comptroller to transfer funds to the proper subaccount for the estimated cost of right-of-way acquisition for the lands located in the City of Milwaukee. The estimated cost of right-of-way acquisition is $25,000.
Body
Whereas, The Common Council of the City of Milwaukee adopted Resolution File Number 030686 on September 23, 2003, authorizing and directing the Commissioner of Public Works to execute a cost sharing agreement with the City of Wauwatosa; and
Whereas, The City of Wauwatosa and City of Milwaukee have acquired the consulting firm, Ayres Associates, Inc. to undertake the engineering work for the subject project; and
Whereas, Ayres Associates, as part of the preliminary engineering for this project, has prepared a right-of-way plat to include real estate needed for the proposed alignment; and
Whereas, It is necessary that the Common Council approve the plat of right-of-way required for the project and authorize the acquisition of lands or interests, as shown on the right-of-way plat; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the right-of-way plat for North 124th Street from West Ruby Avenue to West Hampton Avenue (portions in the City of Wauwatosa) be approved, a draft copy of which is attached to Common Council Resolution File Number , and is incorporated in this resolution by reference as though set forth in full, and that the City Engineer and the Commissioner of Public Works and the Commissioner of the Department of City Development are authorized and directed to affix their signatures to the plat; and, be it
Further Resolved, the City Engineer is hereby authorized and directed, pursuant to Section 62.22 of the Wisconsin Statutes, to acquire lands or interests in lands, as shown on the approved plat of right-of-way, in the name of the City of Milwaukee; and be it
Further Resolved, That the City Engineer is authorized to sign relocation orders, awards of damages and other documents required by the right-of-way acquisition process; and, be it
Further Resolved, That minor revisions in the above plat to meet altered and unforeseen conditions encountered during acquisition of right-of-way are hereby authorized and approved; and, be it
Further Resolved, That the City Engineer is hereby authorized and directed to execute all acquisition documents as may be required for the acquisition of the right-of-way; and, be it
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Street Resurface/reconstruct, the necessary Project/Grant Chartfield Values for the project (Expenditure) and transfer to any of these accounts the amount required under City Accounting Policy but not to exceed a 10 percent increase in the total amount reserved as follows:
