Title

Substitute resolution relating to water service to the City of New Berlin.

Analysis

In order to evaluate the feasibility of amending the current water service agreement between Milwaukee and New Berlin to allow for the expansion of the City of New Berlin water service area to include the middle one-third area within the municipal limits contained within the MMSD sewerage system but west of the subcontinental divide, this resolution directs:

 

1.                     The Milwaukee Water Works, Legislative Reference Bureau and Department of City Development to study and evaluate the opportunity to expand the City of New Berlin service area beyond the subcontinental divide.

2.                     The proper City officials to request that the Wisconsin Department of Natural Resources evaluate the implications of expanding the City of New Berlin water service area west of the subcontinental divide but within the MMSD service area.

When completed, those feasibility reports will be submitted to the Common Council for purposes of evaluating the feasibility of amending the current water services agreement between the City of Milwaukee and the City of New Berlin to enlarge the service area to include the middle one-third area in the City of New Berlin.

 

Body

Whereas, The Council of Great Lakes Governors, represented by 10 jurisdictions - Wisconsin; Illinois; Indiana; Michigan; Minnesota; New York; Ohio; Pennsylvania; Ontario, and Quebec Canada - collectively manages Lake Michigan water issues under Annex 2001, a charter amendment; and

 

Whereas, Annex 2001 agreements were developed by representatives from the 10 jurisdictions’ environmental agencies to define how the Council of Great Lakes Governors manages water quantity issues, distribution of water from the Great Lakes and water diversions beyond the subcontinental divide; and

Whereas, Diversions of water outside the Great Lakes Basin, west of the subcontinental divide should be evaluated by the Wisconsin Department of Natural Resources for environmental and ecological implications and compliance with Annex 2001; and

 

Whereas, In the City of New Berlin, only the eastern portion, to approximately Moorland Rd., lies east of the subcontinental divide, within the Lake Michigan Watershed; and

 

Whereas, The City of New Berlin receives water from Milwaukee under the terms of an “Agreement Between the City of Milwaukee and the City of New Berlin for the Purchase of Water at Wholesale”, pursuant to Common Council Resolution File No. 021750, adopted June 17, 2003; and

 

Whereas, This water service agreement defines the area to be served with water as the municipal limits of New Berlin east of the subcontinental divide and requires that no water may be resold outside that service area without the permission of the City of Milwaukee; and

 

Whereas, There may be an opportunity to increase Water Works revenues by providing water service to the middle one-third of New Berlin, which would require amending the current water service agreement with New Berlin, and it would be desirable to assess the feasibility of exploring new revenue generating opportunities by increasing volume sales while providing an excellent alternative potable water source to an area currently reliant upon well water high in radium content; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officials shall request that the Wisconsin Department of Natural Resources evaluate the implications of expanding the City of New Berlin water service area west of the subcontinental divide but within the MMSD service area; and, be it

 

Further Resolved, By the Common Council of the City of Milwaukee that the Water Works, the Legislative Reference Bureau and the Department of City Development are directed to study and evaluate the feasibility of expanding proposal to expand the City of New Berlin water service area beyond the subcontinental divide, pursuant to the procedures specified in Common Council Resolution File Numbers 980871 and 020459; and, be it

 

Further Resolved, That the resulting reports shall be submitted to the Common Council for the purposes of evaluating the amending of the current water services agreement between the City of Milwaukee and the City of New Berlin to enlarge the service area to include properties located in the middle one-third of the municipal limits contained within the MMSD sewerage system but outside the subcontinental divide.
