This ordinance creates the office of municipal court commissioner and provisions for appointment and supervision, eligibility, salary, length of term, ethical code and prohibition from engaging in legal practice before the municipal court.
BODY:
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1.      Chapter 315 of the code is created to read:
 
CHAPTER 315. MUNICIPAL COURT
 
315-1.      Municipal Court Commissioners.
 
1.      CREATION. Pursuant to the authority of s. 755.19(1), Wis. Stats., as amended, there is established the office of municipal court commissioner.
 
2.      APPOINTMENT AND SUPERVISION. Municipal court commissioners shall be appointed by the presiding judge of the municipal court to perform their duties as specified in s. 755.19(2), Wis. Stats., as amended, and shall be supervised by the judge whose cases the commissioner is hearing. Upon appointment, and for the duration of a commissioner's employment, a commissioner shall comply with the judicial education required by SCR ch. 33, Wisconsin supreme court rules, as amended, as applicable to municipal judges.
 
3.      ELIGIBILITY. A municipal court commissioner shall be an attorney licensed to practice law in Wisconsin and shall have practiced as an attorney for at least 3 years immediately prior to appointment. A municipal court commissioner shall be a resident of the city of Milwaukee.
 
4.      SALARY. The rates of pay in salary of municipal court commissioner shall be determined by the common council.
 
5.      LENGTH OF TERM. The term of office of municipal court commissioner shall expire December 31 of each year.
 
6.      CODE OF ETHICS. Municipal court commissioners shall comply with the provisions of ch. 303 and SCR ch. 60, Wisconsin supreme court rules, as amended, as applicable to part-time municipal judges.
 
7.      PROHIBITION FROM LEGAL PRACTICE BEFORE THE MUNICIPAL COURT. During the period of employment as municipal court commissioner, a commissioner shall not engage in legal practice before the municipal court.
