This resolution expresses the City of Milwaukee's support of the Soo Line Railroad Company/CP Rail System intention to permanently close the at-grade railroad crossing with its tracks and North 12th Street, immediately north of West Mt. Vernon Avenue. This resolution also authorizes the proper City officials or their designees to appear at a hearing on the matter before the State of Wisconsin Office of the Commissioner of Railroads to put forth the City's official support of the permanent closure as herein stated.
BODY:
Whereas, The Soo Line Railroad Company (Soo Line) operates and maintains east-west mainline railroad trackage located between West St. Paul Avenue and the Menomonee River; and
Whereas, The City of Milwaukee acquired a highway easement from the Soo Line for the widening and extension of North 12th Street across the Soo Line right-of-way; and
Whereas, The Soo Line filed a petition with the Office of the Commissioner of Railroads of the State of Wisconsin (OCR) August 25, 1998, under Secs. 195.28 and 195.29 Wisconsin State Statutes for the closure of the public at-grade crossing (crossing #386498R) of the Soo Line railroad tracks with North 12th Street, north of West Mt. Vernon Avenue, in the City of Milwaukee; and
Whereas, The OCR has accepted the petition under Docket #9150-RX-481, and will hold a public hearing on the permanent closing of the public crossing to vehicular traffic; and
Whereas, The crossing at North 12th Street has proven to be less than ideal due to its proximity to a similar crossing at North 13th Street; and
Whereas, The overall accessibility to the Menomonee Valley area would be further improved through the creation of a new crossing to be located at some point farther east; and
Whereas, The Soo Line is knowledgeable of the City of Milwaukee's interest in the creation, at some time in the future, of a new crossing at an undetermined location east of North 12th Street; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the City Engineer or his designee is hereby authorized and directed to appear before a public hearing of the OCR in order to express the City's support of the permanent closure to vehicular traffic of the at-grade railroad crossing of North 12th Street, north of West Mt. Vernon Avenue; and, be it
Further Resolved, That, as part of the testimony given at the public hearing of the OCR, the City's desire for a future crossing of the Soo Line right-of-way between Union Station and North 12th Street be made a part of the official record of the hearing.
