Substitute resolution authorizing and directing the proper City of Milwaukee officials to execute an agreement with Furey Filter and Pump, Inc. allowing their private use of a portion of the unpaved North 124th Street public right-of-way for access to the side and rear of their property located at 12300 West Carmen Avenue and for some parking, in the 15th Aldermanic District.

This resolution authorizes and directs the proper City of Milwaukee officials to execute an agreement with Furey Filter and Pump, Inc. allowing their private use of the unpaved North 124th Street public right-of-way for access to the side and rear of their property at 12300 West Carmen Avenue and for some parking.
BODY:
Whereas, North 124th Street north of West Carmen Avenue is presently an unpaved public right-of-way; and
Whereas, Members of the Furey family, owners of Furey Filter and Pump, Inc. (Furey) own the property located at 12300 West Carmen Avenue on the northeast corner of West Carmen Avenue and North 124th Street; and
Whereas, Furey has requested use of North 124th Street for access to their property and parking for their property; and
Whereas, Permission for Furey to utilize the unimproved North 124th Street right-of-way for the construction of a driveway and driveway approach for such access and for parking can be granted in a Special Permission Agreement; and
Whereas, A Special Permission Agreement has been prepared, which specifies Furey shall bear all construction and maintenance costs associated with such access and parking; and
Whereas, Permission to allow Furey the private use of the North 124th Street public right-of-way for such access and parking can only be approved by the Common Council; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the proper City of Milwaukee officials are authorized and directed to execute a Special Permission Agreement allowing Furey Filter and Pump, Inc. the private use of a portion of the unimproved North 124th Street public right-of-way for access to his property and parking adjacent to 12300 West Carmen Avenue, under the terms and conditions specified in the Special Permission Agreement attached to this Common Council File, and incorporated in this resolution by reference as though set forth in full; and, be it
Further Resolved, That the City Clerk is directed to submit the Special Permission Agreement to the Milwaukee County Register of Deeds for recording against the property described in the Agreement.
