Title

Substitute resolution approving a Milwaukee Civic Partnership Initiative contract agreement with Verizon Wireless.

Analysis

This resolution approves the addition of Verizon small cell technology to the Milwaukee Civic Partnership Initiative asset inventory and valuation list provided by The Superlative Group, Inc.  This resolution also approves a Small Cell Master Lease Agreement with Verizon Wireless and authorizes the proper City officials to enter into this agreement on behalf of the City of Milwaukee.

Body

Whereas, The Common Council adopted Resolution File Number 140517 on November 5, 2014, approving a Milwaukee Civic Partnership Initiative asset inventory valuation and list compiled by The Superlative Group, Inc.; and

 

Whereas, This asset inventory and valuation list did not include Verizon small cell technology; and

 

Whereas, Verizon small cell technology is mounted on street lights, to improve wireless and cellular coverage in areas where buildings can normally get in the way of signals; and

 

Whereas, The Superlative Group, Inc. has compiled and provided a Verizon small cell technology asset valuation; and

 

Whereas, Section 310-21 of the Code provides that the Department of Administration shall make recommendations to the Common Council concerning the marketing of City assets; and

 

Whereas, The Department of Administration and the Department of Public Works have been working with the City Attorney’s Office and The Superlative Group, Inc. to negotiate a contract agreement with Verizon Wireless for the placement of Verizon small cell technology on City street lights; and

 

Whereas, This contract agreement includes the following:

 

1. An initial term of 5 years with 4 additional 5-year renewals (25 years total).

2. Verizon small cell technology will be placed on City street lights. 

3. Verizon Wireless has agreed to pay the City rent for each pole it uses.  Rental payments will initially be $150/month.  This amount will increase by 3% each year.

4. Verizon Wireless will supply and be responsible for the cost of installation of each new pole.

5. The Commissioner of Public Works will review and approve or disprove the design, and will issue a permit for each installation.

6. Verizon Wireless has agreed to install equipment of the type and frequency which will not cause harmful interference which is measurable in accordance with existing industry standards.

7. The Superlative Group, Inc. will receive a commission based on the rent actually collected.

Whereas, The Common Council adopted Resolution File Number 130676 on September 24, 2013, which included a provision that all Milwaukee Civic Partnership Initiative contracts the City enters into with The Superlative Group, Inc., shall be approved by the Common Council; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Common Council approves the addition of Verizon small cell technology to the Milwaukee Civic Partnership Initiative asset inventory and valuation list entitled, “Milwaukee Small Cell Wireless Network Summary Valuation Brief”, a copy of which attached to this file; and, be it

 

Further Resolved, That the Common Council approves a Small Cell Master Lease Agreement with Verizon Wireless, a copy of which is attached to this file, for the placement of small cell technology on City street lights; and, be it

 

Further Resolved, That the proper City officials are authorized to enter into this contract agreement on behalf of the City of Milwaukee.
