TITL:
Substitute resolution approving participation in a 66.30 intergovernmental agreement for the provision of animal control services.
ANLS:
This resolution authorizes the proper city officials to execute a 66.30 agreement with other participating Milwaukee County municipalities to establish a jointly-operated animal control services facility for domestic animals. It further authorizes the Health Department, upon presentation of a quarterly financial and billing statement, to expend up to $112,473 in capital costs each year and up to $1,285,078 in initial operating costs. Annual cost increases are not to exceed the lesser of: (a) the percentage of increase in the U.S. Urban CPI index, all wage earners, for the twelve (12) months ended on September 30 next preceding the budget year, (b) the percentage of increase in the Gross Domestic Product Price index for the twelve (12) months ending on September 30 next preceding the budget year, or (c) the limit for increases in municipal budgets certified by the Wisconsin Department of Revenue for the purposes of Section 79.05, Wisconsin Statutes.
BODY:
Whereas, local units of government are required by law to capture, shelter and dispose of stray and unwanted animals that cannot be returned to their owners; and
Whereas, The city and eighteen (18) other municipalities have been contracting with Milwaukee County and the Wisconsin Humane Society for sixty-five (65) years for this service, and the Wisconsin Humane Society has notified the nineteen (19) municipalities of their intent to terminate the contract for said services effective at the end of 1998; and
Whereas, There has been a Planning/Steering Committee comprised of representatives of the city and the other eighteen (18) Milwaukee County municipalities to determine the best course of action; and
Whereas, The Planning/Steering Committee has found that there are advantages to a single animal control facility and program for all communities within Milwaukee County, with the major benefits being the ability to control the level and cost of services, provide a single facility for pet owners to reclaim their stray animals, and to provide a method for the recapture of the cost for such a facility through licensing, fees, penalties and other programs that could provide revenue to offset the property tax cost of such services; and
Whereas, To construct or renovate a facility for purposes of an animal control program and to provide for the operation of such a program, it requires the city to make an initial commitment that is commensurate with the amortization of the capital costs and the operations of a program over such period of time; and
Whereas, The method for the city and the other municipalities coming together for purposes of providing for intergovernmental cooperation is found under Wisconsin Statutes 66.30; and
Whereas, A 66.30 agreement provides the organization and governance that specifically allows for each municipality to participate on an equal basis in the major decisions and direction of such programs, which can be accountable to the public and the taxpayers; and
Whereas, The attached agreement entitled "Domestic Animal Control Services Agreement" is the chartering document for such a 66.30 Intergovernmental Cooperation Agreement; and
Whereas, This Agreement provides the legal structure for a subsequent action to secure capital funds for the construction of a facility for animal control; now therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the proper city officials are authorized to execute the "Domestic Animal Control Services Agreement" whereby the city agrees to join the formation of the Milwaukee Area Domestic Animal Control Commission (MADACC); and, be it
Further Resolved, That the MADACC is authorized to develop a capital budget for the animal control facility not to exceed two million five hundred thousand dollars ($2,500,000); and, be it
Further Resolved, The borrowing issue for such capital funds shall provide for a reimbursement program to Milwaukee County to share the debt service (principal and interest) based upon the city's share of equalized valuation of all participating municipalities; and, be it
Further Resolved, That the total initial operating budget for MADACC shall not exceed one million six hundred thousand dollars ($1,600,000) with the city's share not to exceed one million two hundred eighty-five thousand seventy-eight dollars ($1,285,078) and such costs shall be shared on a basis of usage of the facility by the number of domestic animals sheltered at the facility given the origin of their being found and delivered to the facility in the most recent three (3) years; and, be it
Further Resolved, The annual percent of increase in the total operating budget of the MADACC will not exceed the lesser of: (a) the percentage of increase in the U.S. Urban CPI index, all wage earners for the twelve (12) months ending on September 30 next preceding the budget year, (b) the percentage of increase in the Gross Domestic Product Price index for the twelve (12) months ending on September 30 next preceding the budget year, or (c) the limit for increases in municipal budgets certified by the Wisconsin Department of Revenue for purposes of Wisconsin Statutes, Section 79.05; and, be it
Further Resolved, That upon presentation of a quarterly financial and billing statement, the Milwaukee Health Department is authorized and directed to expend up to forty seven thousand dollars ($47,000) during the first year of the agreement and up to one million two hundred eighty five thousand seventy eight ($1,285,078) during the initial operating year appropriated in the Health Department's Special Fund Account titled "Animal Pound Contract" (01-381-8010) for the purpose stated above; and, be it
Further Resolved, That the MADACC shall annually provide a certified audit to each participating municipality no later than six (6) months after each subsequent year of its operation for the purposes for determining if the expenses for such facility are consistent with this Resolution and the 66.30 Agreement; and, be it
Further Resolved, The operation of the MADACC shall be authorized by the governing body as per the Agreement, and that the selection of a qualified operator shall be an open and competitive process to assure that the operation is efficiently and properly maintained and operated and with the intent to decrease the tax levy impact for supporting such a facility over a reasonable period of time; and, be it
Further Resolved, That the MADACC shall prepare a plan which addresses a reduction in the tax levy cost on a percentage and real basis of the operating budget for this participating municipality; and, be it
Further Resolved, That if the MADACC is not officially created by December 31, 1997, this resolution is hereby rescinded.
