Title

Resolution suspending the expenditure of funds related to the purchase, installation, wiring, and other implementation costs associated with the Video Surveillance Project Initiative from grants, operating funds and capital improvement accounts within the Department of Public Works and the Police Department.

Analysis

This resolution suspends the expenditure of funds related to the purchase, installation, wiring and other implementation costs associated with the Video Surveillance Project Initiative from grants, operating funds, and capital improvement accounts within the Department of Public Works and the Police Department.  The Police Chief is requested to consult with the Common Council and the Commissioner of Public Works as to the location and placement of the cameras, and that such placement and location shall be authorized by Common Council resolution.

 

Body

Whereas, On June 19, 2007, the Common Council adopted File Number 070339, Substitute 2, a resolution reserving up to $2 million from the Common Council Contingent Fund for expenditures by the Milwaukee Police Department relating to the Neighborhood Safety Initiative, and reserving up to $1 million from the 2007 Common Council Contingent Fund for expenditures by the Department of Public Works relating to snow and ice control, and authorizing expenditure for these purposes; and

 

Whereas, An earlier version of the file would have provided $1,975,000 from the Common Council Contingent Fund for the Neighborhood Safety Initiative, $1 million for DPW, and $525,000 for surveillance cameras to be mounted in various high crime areas of the city;  the Finance & Personnel Committee divided the question at its June 13, 2007 meeting, and deleted the $525,000 for the cameras; and

 

Whereas, The Mayor and the Department of Administration - Budget & Management Division then indicated that the cost of the surveillance camera project would be covered by reallocation of funding from DPW’s Capital Improvement Budget - Facilities Account, and the Police Department’s operating budget, and that the reallocation would not require Council action; and

 

Whereas, In a legal opinion dated June 29, 2007, the City Attorney indicated that the Common Council may suspend the expenditure of DPW and Police Department funds related to the purchase and implementation of the surveillance cameras pursuant to Section 18-06-13, Milwaukee City Charter; and

 

Whereas, In a legal opinion dated February 2, 2007, regarding the use of surveillance cameras by the Milwaukee Police Department and the placement of such cameras on public facilities, the City Attorney opined that while custody of the cameras themselves lies with the Police Chief pursuant to Section 62.50(23), Wis. Stat., the Common Council and the Commissioner of Public Works are given control of City property pursuant to Section 7-04, City Charter, including for instance, light poles and traffic signals where surveillance cameras may be placed; and

 

Whereas, The opinion further states that the Police Chief should therefore consult with the Commissioner regarding the placement of such cameras, and that the Common Council could also enact general regulations regarding the placement of such cameras;

and

 

Whereas, A letter dated June 29, 2007 attached to this file from the Budget & Management Director of the Department of Administration to all Common Council members detailed the sources of funding related to the surveillance camera project; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the expenditure of funds related to the purchase, installation, wiring and other implementation costs associated with the surveillance camera project from grants, operating funds, and capital improvement accounts within the Department of Public Works and the Police Department, as outlined in the Budget & Management Director’s letter dated June 29, 2007 and attached to this file, is hereby suspended, as follows:

 

4 cameras (Summerfest and Bradley Center locations) and one monitoring console: 

$199,500.00 in Milwaukee Police Department Grants -- $120,000.00 from Custodial Interrogation Grant, Account Number GR3305207000, and $79,500 from Urban Security Initiative Grant, Account Number GR3310546030.

 

Record Retention System and Dispatch Needs:  $86,000.00 from Police Department Capital Account - Video Capture System, Account Number PL120070100.

 

Fiber Upgrade:  $100,000.00 from Department of Public Works Capital Account - Public Safety Communications, Account Number ST2700700A.

 

Connectivity - Wiring:  $46,000.00 from DPW Capital Account - Street Improvements/Lighting, Account Number ST240070801.

 

11-12 Neighborhood Cameras:  $367,500.00 from DPW Capital Account - Facilities Systems Program, Account Number BU11091200.

 

4-5 Mobile Cameras:  $170,500 from MPD UASI Grant, Account Number GR3310546030.

 

Other:  $34,000.00 from Weed and Seed Grant - This grant has not been awarded yet.  If awarded and received, the grant will commence October 1, 2007.  Hence, no specific account number is available for this purpose yet.

 

Total Project:  $1,003,500.00 ($404,000.00 Grant Funding and $599,500.00 Capital Funding).

Further Resolved, That the Police Chief is requested to consult with the Common Council and the Commissioner of Public Works as to the location and placement of the cameras, and that such placement and location shall be authorized by Common Council resolution.
