This ordinance establishes an $8 annual fee for the maintenance, repair and replacement of solid waste carts and containers provided by the city to owners of single, 2-, 3- or 4- family dwelling units, or condominium units, effective January 1, 1998.
BODY:
Whereas, The city of Milwaukee maintains, repairs and replaces solid waste carts and containers it provides to single, 2-, 3-, and 4- family dwelling units and condominiums, free of charge; and
 
Whereas, The maintenance, repair and replacement of these carts and containers costs the city over $1.2 million annually; and
 
Whereas, It is fiscally prudent and appropriate for the city to charge a fee to recover the cost of maintaining carts and containers; now, therefore
 
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1. Section 79-4-1-am-1 of the code is amended to read:
 
79-4. Waste Container Regulations.
 
1.      PORTABLE CONTAINERS.
 
am.      Responsibility for Providing Portable Waste Containers.
 
am-1. Owners of single, 2-, 3-, or 4--family dwelling units shall be provided carts by the city. >>Effective January 1, 1998, the city shall charge an annual fee to owners of single, 2-, 3-, or 4-family dwelling units to recover costs relating to the maintenance, repair and replacement of carts provided by the city.<<
 
Part 2. Section 79-4-4 of the code is amended to read:
 
4.      CONDOMINIUMS. Where collection service is provided by the department to a condominium complex, the city shall provide containers of a type and quantity determined at the discretion of the division of sanitation to the owners of such condominium units in the same structure or condominium design, regardless of the number of units in the complex. >>Effective January 1, 1998, the city shall charge an annual fee to owners of condominium units to recover costs relating to the maintenance, repair and replacement of containers provided by the city.<<
 
Part 3. Section 81-114.3 of the code is created to read:
 
81-114.3. Solid Waste Cart and Container Maintenance, Repair and Replacement Fee. The annual fee for maintenance, repair and replacement of solid waste carts and containers provided by the city to owners of single, 2-, 3- or 4-family dwelling units, or condominium units, shall be $8 per unit. (See s. 79-4.)
