Analysis

This resolution authorizes the proper City Officials to execute Conveyances of Rights in Land, Quit Claim Deeds, and Temporary Construction Easements to the Wisconsin Department of Transportation, in areas located along Interstate 94 East West Freeway from 70^th Street to 16^th Street, in the 4^th, 8^th, and 10^th Aldermanic Districts.

Body

Whereas, The Wisconsin Department of Transportation (“DOT”) is undertaking highway improvement projects, DOT Project I.D. Nos. 1060-27-71 & 1060-27-74, concerning improvements to along Interstate 94 East West Freeway from 70^th Street to 16^th Street, and in conjunction therewith, the DOT has requested that the City of Milwaukee provide Conveyances of Rights in Land, Quit Claim Deeds, and Temporary Construction Easements, in defined areas within the improvement areas; and

Whereas, The areas where the DOT wants the City to grant the Conveyances of Rights in Land, Quit Claim Deeds, and Temporary Construction Easements within Parcels 3, 4, and 7 of Exhibit A, Parcel 23 of Exhibit B, and Parcel 108 of Exhibit C, which exhibits are part of this file; and

Whereas, The City obtained certain easement rights for public sewer facilities (sewer easements) by virtue of easement documents recorded in the Milwaukee County Register of Deeds as Document Nos. 39103, 1406374, 3864135, 4601340, 4685932, 5296249, 5494363, 5510012, 5522874, and 5556865 respectively within Parcels 3, 4, 7, 23, and 108, where the sewer easements are located; and

Whereas, The City, by its DPW with assistance from the City Attorney’s Office, negotiated the Conveyances of Rights in Land, Quit Claim Deeds, and Temporary Construction Easement that is part of this file to accomplish the DOT’s request; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officers, including the DPW Commissioner, are hereby authorized: (i) to sign the Conveyances of Rights in Land, Quit Claim Deeds, and Temporary Construction Easements, affecting Parcels 3, 4, 7, 24, and 108, in the form and substance as those documents have also been submitted to this file (or in substantially the same form and substance as submitted); and (ii) to take such acts as are necessary to effectuate the intent of this resolution.
