- Analysis - This substitute resolution grants permission to the Village of Menomonee Falls to connect to a City of Milwaukee 48-inch diameter sanitary sewer in West Park Place in the area designated as the Jobs 2000 Corridor.
 
 
BODY:
Whereas, The City of Milwaukee (City) and the Village of Menomonee Falls (Village) have cooperated in the creation of the Jobs 2000 Corridor project; and
 
Whereas, The Village is interested in installing sanitary sewers to serve the Jobs 2000 Corridor project area; and
 
Whereas, A sanitary sewer manhole exists in West Park Place within the City's limits at a point 420'± southeast of the east line of North 124th Street, said manhole being the junction point of 48-inch diameter sanitary sewers running northeasterly and southwesterly in Sewer Easement SE-2415A; and
 
Whereas, The Board of Trustees of the Village adopted a resolution requesting permission from the City to connect to said sanitary sewer; and
 
Whereas, Said sanitary sewer was designed to serve that portion of the Jobs 2000 Corridor lying north of the 41/45 Freeway in the Village; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the Village is hereby given permission to connect to said sanitary sewer manhole by constructing a sanitary sewer in West Park Place at point east of North 124th Street or in the vicinity of West Park Place under the following terms and conditions.
 
1. The final location and alignment of said sanitary sewer shall be determined upon submittal of the field survey notes by the Village to the Commissioner of Public Works for review and approval.
 
2. Sanitary sewer flows from the Jobs 2000 project area into the City's sanitary manhole shall not exceed 8.30 cubic feet per second (8.30 cfs).
 
3. Said sanitary sewer shall be constructed at the expense of the Village.
 
4. Said sanitary sewer shall be constructed of sufficient size and at an elevation to accept gravity sewage flows from the Jobs 2000 Corridor project area.
 
5. The Village shall submit the sewer design sheets system plans and three (3) sets of sewer plans to the Commissioner of Public Works for approval prior to construction of the sanitary sewer.
 
6. The Village shall cause its contractor to obtain an excavating permit from the Department of Public Works prior to commencing work within the City limits.
 
7. Backfilling and trench surfacing within the limits of the City shall comply with the specifications of the Department of Public Works of the City of Milwaukee.
 
8. The Village shall provide the City with an As-built plan of the sanitary sewer within City limits.
 
9. At such time as the City deems it necessary to construct a sanitary sewer in North 124th Street, from West Park Place to West Bradley Road, the Village shall allow the City to connect said sanitary sewer to the sanitary sewer proposed to be built by the Village.
 
10. The Village shall permit City property owners abutting West Park Place to connect to said sanitary sewer upon payment of a sewer connection charge, said charge not to exceed the City front-foot assessment rate for sanitary sewers in affect at the time of the application. Said connection charges shall be paid to the Village, and the Village in return shall furnish a copy of the receipt to the City, which will issue the sewer connection permit. City property owners shall be exempt from payment of any annual fee or sewer service charge assessed by the Village.
 
11. Said sanitary sewer shall be maintained by and at the expense of the Village.

Further Resolved, That a certified copy of this resolution be forwarded to the Village of Menomonee Falls.
