Analysis

This ordinance specifies the following to be effective pay period 13, 2007:

1.  Eligibility of new management pay plan employes for sick leave shall begin immediately as it is accrued each pay period.

2.  Eligibility of new management employes for vacation benefits shall begin immediately as it is accrued each pay period.  If a management employee leaves the service of the city before 12 months of employment any vacation accrued and used shall be deemed earned and shall not be deducted from the employees last paycheck.

3.  A third week of vacation time may be authorized by the department of employe relations, with the concurrence of the chair of the committee on finance and personnel, if needed to recruit a new management pay plan employe.

4.  Codifies existing tuition benefits for management employes (now in resolution file number 061209) by creating s. 350-206 of the code.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1.  Section 350-37-6 of the code is renumbered 350-37-6-a and amended to read:

 

350-37. Sick and Disability Leave.

6.  ELIGIBILITY.  >>a.<<Eligibility for sick and disability leave allowance  >> ,except for management employes as provided in par. b,<< shall begin after the completion of 6 months of actual service following regular appointment, but accumulations shall be retroactive to the time of regular appointment.  Eligibility of city laborers, regular or sanitation workers for sick and disability leave allowance shall begin immediately upon appointment to the title, city laborer (regular) or sanitation worker, but accumulation shall be retroactive to the leave accrued while holding the title city laborer (seasonal) as provided in sub. 1.  The changes in this ordinance shall apply only to eligible employes holding positions represented by certified bargaining units which have reached agreement with the city on a labor contract containing the changes described herein, at a time this ordinance change is approved, and to eligible employes not represented by a certified bargaining unit.

 

Part 2.  Section 350-37-6-b of the code is created to read:

 

b.  Effective pay period 13, 2007, eligibility of management employes for sick and disability leave shall begin immediately as it is accrued each pay period.

 

Part 3.  350-40-2-a-1 of the code is amended to read:

 

350-40.                     Vacations.

2.  ELIGIBILITY.  a.  General Eligibility Requirements. a-1.  Eligibility for a vacation shall begin after completion of 12 months of active service following appointment except as otherwise provided in some labor agreements  >> and for management employes<<.  A department head may permit an employe to take vacation after 6 months of active service if the convenience of the service is promoted and if that employe is expected to complete a full year of service.  [[Also, effective pay period 1, 2005, management employes may be allowed at the discretion of the department head to use vacation within the first 12 months of employment if the convenience of the service would be promoted.  However, if the employe leaves the service of the city before the completion of the initial 12 month period, that vacation shall be deemed unearned and payments made during the vacation period shall be deducted upon termination of employment.  Employes who are not expected by the department head to work 12 consecutive months shall be eligible for vacation only after completing 12 months of service.]]  >>Effective pay period 13, 2007, eligibility of management employes for vacation benefits shall begin immediately as it is accrued each pay period.<<

 

Part 4.  Section 350-40-3-a-1-h of the code is renumbered 350-40-3-a-1-i.

 

Part 5.  Section 350-40-3-a-1-h of the code is created to read:

 

350-40. Vacations.

3.  TIME EARNED FOR ANNUAL VACATION PERIOD.

a.  Full Time Employes. 

a-1-h.  Effective pay period 13, 2007, if it becomes necessary to recruit a management employe at a vacation rate above the minimum of 3.7 hours per pay period, the department of employe relations, with the concurrence of the chair of the committee on finance and personnel, may authorize vacation at the rate of 5.3 hours per pay period which will provide a third week of vacation.  A listing of appointments made pursuant to this provision shall be communicated to the committee on finance and personnel.

 

Part 6.  Section 350-206 of the code is created to read:

 

350-206. Tuition Benefits; Management Pay Plan Employes.

Employes in the management pay plan shall be eligible for tuition benefits relating to tuition, laboratory fees and required textbooks.  For the 2-year calendar period of 2007 and 2008, benefits are a combined maximum of $2,400.  The following provisions apply:

1.  Up to $500 of tuition benefits per year may be used for job-related certifications or license fees.

2.  Up to a combined maximum of $2,400 in tuition benefits may be used for membership dues during calendar years 2007 and 2008.

 

Part 7.  Resolution file number 061209, adopted on February 6, 2007, relating to tuition benefits for management employes for 2007-2008, is rescinded.
