-Analysis-

 

This Resolution authorizes execution of an Easement and Lease Agreement, together with related Construction and Park Easements to allow the development of the North Urban Park through the construction of an addition to the existing Milwaukee County War Memorial Center Building as well as the construction of related improvements in the North Urban Park and further authorizes execution of a Fill Agreement applicable to the former Gun Club site located adjacent to the Linnwood Water Filtration Plant.

BODY:

Whereas, The Milwaukee Art Museum, Inc. ("Museum") is undertaking the construction of an addition located immediately to the south of the existing Milwaukee County War Memorial Center Building and the construction of improvements in the North Urban Park (collectively the "Project"); and

 

Whereas, A portion of the Project will be located upon the North Urban Park which was ceded to the City of Milwaukee by the State of Wisconsin and is under the jurisdiction of the Board of Harbor Commissioners; and

 

Whereas, The Board of Harbor Commissioners, in approving the Easement and Lease Agreement, has found and determined that Museum's construction of the Project is a great public benefit and is wholly consistent with the terms of the Resolution of the Board of Harbor Commissioners adopted on June 16, 1978, reserving the area commonly known as the North Harbor Tract, including the North Urban Park, for recreational use and developments which support recreational use; and

 

Whereas, The Common Council of the City of Milwaukee hereby finds that the Project is of great public benefit and is a recreational use which promotes the enjoyment and use of the natural scenic beauty of the Milwaukee lakefront by the general public; and

 

Whereas, The Easement and Lease Agreement, the Construction Easement, the Park Easement, and the Fill Agreement collectively provide for the construction and long-term operation of the Project; and

 

Whereas, Copies of the Easement and Lease Agreement, the Construction Easement, the Park Easement, and the Fill Agreement are on file with the Common Council and attached to Common Council Resolution File No. 961684; and

 

Whereas, The Easement and Lease Agreement provides for the payment of rent in an initial amount of $100,000.00, which is to be recalculated upon completion of the Project in accordance with paragraph 9 of the Easement and Lease Agreement, which funds are to be placed in a fund established by the City Comptroller's Office in accordance with the intent that such funds be earmarked and used for port purposes, as determined by the Board of Harbor Commissioners, now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the Easement and Lease Agreement, the Construction Easement, the Park Easement, and the Fill Agreement are hereby approved by the City of Milwaukee and the proper City officers are hereby authorized and directed to execute such agreements and instruments in the form on file with the City, with such minor non-substantive revisions as may be approved by the Municipal Port Director and the Office of the City Attorney; and, be it,

 

Further Resolved, That the proper City officials are hereby authorized and directed to take such actions as may be required to implement such agreements and instruments and that the rent payments provided for pursuant to the terms of the Easement and Lease Agreement be credited to a City Fund Account as designated by the City Comptroller, in accordance with the intent that such funds be earmarked and used for Port purposes, as determined by the Board of Harbor Commissioners.
