Substitute resolution authorizing and directing the Commissioner of Public Works to execute a document titled "State/Municipal Agreement for a Highway Improvement Project" with the Wisconsin Department of Transportation for the programming and construction of various projects with Federal and/or State aid.

This resolution authorizes and directs the Commissioner of Public Works to execute a State/Municipal Agreement for Highway Improvements. The resolution also directs the City Engineer to negotiate a Jurisdictional Transfer Agreement as well as a cost sharing and operational/maintenance agreement with the Village of Menomonee Falls. The Commissioner of Public Works is authorized to execute the cost sharing and operational/maintenance agreement.
BODY:
Whereas, The City of Milwaukee and the Village of Menomonee Falls have requested the Wisconsin Department of Transportation (WISDOT) to program and construct various streets and State Trunk Highways with State and Federal Aid; and
Whereas, The WISDOT has given preliminary approval and submitted a "State/Municipal Agreement for a Highway Improvement Project" for execution by the City and Village for the construction of:
Project I.D: 2130-08-00, 20, 40, 70.
West Good Hope Road from the West County Line (North 124th Street) to the USH 41-45 Interchange with West Good Hope Road
Project I.D. 2130-06-00, 20, 40, 70.
USH 41-45 Interchange with North 124th Street and North 124th from the USH 41-45 Interchange to Dretzka Park Entrance Road
Project I.D. 2175-04-00, 20, 40, 70.
North 124th Street from Dretzka Park Entrance Road to West Brown Deer Road.

Whereas, The Village of Menomonee Falls has requested a WISDOT Transportation Economic Assistance (TEA) Grant of $1,000,000 and a Wisconsin Department of Commerce Public Facilities Economic Development Grant of $1,000,000 to assist in funding these highway improvements; and
Whereas, The City and the Village have tentatively agreed to apply the TEA and Economic Development grants toward the local share as well as participate in the remaining local share of project costs; and
Whereas, In consideration for programming and construction of the aforementioned streets and highways, the WISDOT is requesting the City and Village accept jurisdictional transfer of various local access frontage roads and the transfer to Connecting Highway status of portions of STH 145 and STH 175; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized and directed to execute the agreement for the programming and construction of the aforementioned streets and highways with Federal and/or State Aid, a copy of which is attached to Common Council Resolution File Number 970113, and is incorporated in this resolution by reference as though set forth in full; and, be it
Further Resolved, That the City Engineer is authorized and directed to negotiate pursuant to Section 84.02 (8) Wisconsin Statutes, a Jurisdictional Transfer Agreement facilitating the transfer from State of Wisconsin control of several USH 41-45 local access frontage roads between West Florist Avenue and North 124th Street to the City of Milwaukee. Subsequently, the Transfer Agreement shall be submitted to the Common Council for its consideration and acceptance; and, be it
Further Resolved, That the City Engineer is authorized and directed to negotiate and the Commissioner of Public Works is authorized to execute a Cost Sharing and Maintenance Agreement(s) with the Village of Menomonee Falls regarding the construction and operation/maintenance of West Good Hope Road from the West County Line to the USH 41-45 Interchange and North 124th Street from the USH 41-45 Interchange to West Brown Deer Road.
