This resolution will accept an easement agreement from the C.P. Rail System for two retaining walls on C.P. Rail System right-of-way necessary for the reconstruction of the West Galena Street Bridge structure over the railroad tracks, in the City of Milwaukee.

BODY:
Whereas, The Common Council of the City of Milwaukee adopted Resolution File Number 950846 on October 4, 1995 authorizing and directing the Commissioner of Public Works to execute a program agreement with the Wisconsin Department of Transportation (WISDOT) for programming the reconstruction of the West Galena Street Overpass structure of the C.P. Railway System with Federal and/or State Aid funds under the Local Bridge Replacement Program; and
Whereas, The Common Council, by Resolution File Number 981330, adopted January 19, 1999, approved and authorized the execution of a stipulation between the City, the WISDOT, and the C.P. Rail System for the reconstruction and maintenance of the West Galena Street Bridge structure over the C.P. Rail System tracks in the City of Milwaukee; and
Whereas, In addition to a stipulation for the reconstruction of the West Galena Street overpass structure, an easement agreement is necessary between the City and the C.P. Rail System for work associated with the subject bridge project which is located on C.P. Rail System right-of-way and outside the street right-of-way; and
Whereas, Negotiations have taken place between the C.P. Rail System and the WISDOT, acting on behalf of the City of Milwaukee, to negotiate an easement agreement regarding the use of C.P. Rail system right-of-way during the reconstruction of the overpass structure; and
Whereas, The WISDOT has forwarded the easement agreement to the City of Milwaukee, a copy of which is included in Resolution File Number 991744 and referenced in full; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee hereby accepts the easement from the C. P. Rail System, for the construction of two retaining walls as part of the reconstruction of the West Galena Street Bridge structure over the C.P. Rail System tracks located in the City of Milwaukee.
