Substitute resolution declaring as surplus and authorizing the conveyance, subject to certain conditions, of a portion of the City-owned property at 2221 West Auer Avenue and a portion of the City-owned property under the jurisdiction of the Milwaukee Board of School Directors at 2319 West Auer Avenue to the Milwaukee Police Athletic League, Inc., for construction of a youth activity center.

This resolution declares portions of the adjoining City-owned properties at 2221 West Auer Avenue and 2319 West Auer Avenue surplus to City needs and authorizes the sale of this surplus property to the Milwaukee Police Athletic League, Inc., for $1.00 subject to certain conditions. The Police Athletic League plans to construct a youth activity center on the surplus property.
BODY:
Whereas, The Common Council finds that a portion of the City-owned property located at 2221 West Auer Avenue is surplus to City needs; and
Whereas, The Milwaukee Board of School Directors has determined that a portion of the adjoining City-owned property under its jurisdiction at 2319 West Auer Avenue is surplus to the needs of Milwaukee Public Schools; and
Whereas, The Milwaukee Police Athletic League would like to construct a youth activity center on portions of these 2 parcels; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the portions of the City-owned parcels located at 2221 West Auer Avenue (tax key no. 285-0243-120) and 2319 West Auer Avenue (tax key no. 285-1511-110) described in the legal description attached to this file are declared surplus; and, be it
Further Resolved, That said property shall be conveyed to the Milwaukee Police Athletic League, Inc., for $1.00 and other valuable consideration provided the Police Athletic League meets the following contingencies:
1. Submission to, and approval by, the Department of City Development of site and building plans.
2. Submission of satisfactory evidence that sufficient funds are available to undertake and complete construction of the proposed Police Athletic League youth activity center before December 31, 2001.
3. Closing of the sale within 18 months of adoption of this resolution by the Common Council of the City of Milwaukee. If such closing does not occur, the conveyance shall be null and void.
; and, be it
Further Resolved, That said property is sold in as "as is" condition, and the City of Milwaukee is not responsible now or in the future for any existing subsoil conditions; and, be it
Further Resolved, That the Department of City Development shall provide a complete phase I environmental assessment of the property prior to closing; and, be it
Further Resolved, That Milwaukee Public Schools shall continue to operate and maintain the playfield on the subject property until the date of conveyance; and, be it
Further Resolved, That the proper City officials are authorized and directed to perform such acts as may be required to consummate conveyance of the subject property to the Police Athletic League; and, be it
Further Resolved, That the City Comptroller is authorized and directed to credit the proceeds from this sale to the City's general land sales proceeds account (account no. 01-191-9944).
