This resolution will vacate portions of North Commerce Street which will not be needed when the street is relocated and realigned.

BODY:

Whereas, A resolution directing a report on the proposed vacation was presented to the Common Council of the City of Milwaukee by the City of Milwaukee on the 14th day of October, 1997 for the vacation of portions of North Commerce Street between East Pleasant Street and North Holton Street in the Beerline "B" Redevelopment Project, in the 6th Aldermanic District; and

 

Whereas, A resolution directing a report on the proposed vacation was passed by the Common Council on November 4, 1997 under File No. 971002; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the fee of $218 otherwise required to be paid to the City Treasurer is waived, and the City Treasurer is authorized to waive said fee pursuant to Ordinance 234 of the City of Milwaukee, passed July 11, 1961; and, be it

 

Further Resolved, That the following described portions of North Commerce Street between East Pleasant Street and North Holton Street in the Beerline "B" Redevelopment Project, described as follows:

 

PARCEL 1: All that part of North Commerce Street, as presently laid out, which abuts Lot 88 in Plat of Lots 2 and 3, a recorded subdivision, in the Northwest 1/4 of Section 21, Township 7 North, Range 22 East which lies between the present Northwesterly line of North Commerce Street and a line described as commencing at the point of intersection of the East line of North Palmer Street and the North line of East Pleasant Street; thence South 89 deg. 58 min. 47 sec. East along the North line of East Pleasant Street 95.30 feet to a point in a curve and the point of beginning of the line to be described; thence Northeasterly 114.27 feet along the arc of said curve which has a radius of 500.00 feet with its center to the Northwest having a central angle of 13 deg. 05 min. 39 sec. and whose chord bears North 56 deg. 22 min. 30.5 sec. East 114.02 feet to a point of compound curve; thence Northeasterly 33.24 feet along the arc of said curve which has a radius of 167.00 feet with its center to the Northwest having a central angle of 11 deg. 24 min. 10 sec. and whose chord bears North 44 deg. 07 min. 36 sec. East 33.18 feet to a point of tangency; thence North 38 deg. 25 min. 31 sec. East 241.43 feet to a point of curve; thence Northeasterly 35.02 feet along the arc of said curve which has a radius of 167.00 feet with its center to the Northwest having a central angle of 12 deg. 00 min. 56 sec. and whose chord bears North 32 deg. 25 min. 03 sec. East 34.96 feet to a point of tangency; thence North 26 deg. 24 min. 35 sec. East 108.31 feet to a point of curve; thence Northeasterly 597.22 feet along the arc of said curve which has a radius of 945.00 feet with its center to the Southeast having a central angle of 36 deg. 12 min. 35 sec. and whose chord bears North 44 deg. 30 min. 52.5 sec. East 587.33 feet to the point of termination of the above described line.

 

PARCEL 2: All that part of North Commerce Street, as presently laid out, which abuts Lot 2 of Schroeder & Trostel's Subdivision, a recorded subdivision, and Parcel 1 of Certified Survey Map No. 1433, in the Southeast 1/4 and Northeast 1/4 of Section 20 and the Northwest 1/4 of Section 21, Township 7 North, Range 22 East, which lies between the present Southeasterly line of North Commerce Street and a line described as commencing at the point of intersection of the East line of North Palmer Street and the North line of East Pleasant Street; thence South 89 deg. 58 min. 47 sec. East along the North line of East Pleasant Street 95.30 feet to a point; thence South 27 deg. 04 min. 40 sec. East 66.00 feet to a point in a curve and the point of beginning of the line to be described; thence Northeasterly 129.35 feet along the arc of said curve which has a radius of 566.00 feet with its center to the Northwest having a central angle of 13 deg. 05 min. 39 sec. and whose chord bears North 56 deg. 22 min. 30.5 sec. East 129.07 feet to a point of compound curve; thence Northeasterly 46.37 feet along the arc of said curve which has a radius of 233.00 feet with its center to the Northwest having a central angle of 11 deg. 24 min. 10 sec. and whose chord bears North 44 deg. 07 min. 36 sec. East 46.29 feet to a point of tangency; thence North 38 deg. 25 min. 31 sec. East 241.43 feet to a point of curve; thence Northeasterly 48.86 feet along the arc of said curve which has a radius of 233.00 feet with its center to the Northwest having a central angle of 12 deg. 00 min. 56 sec. and whose chord bears North 32 deg. 25 min. 03 sec. East 48.77 feet to a point of tangency; thence North 26 deg. 24 min. 35 sec. East 108.31 feet to the point of termination of the above described line are vacated for the reason that it provides no public utility and it is in the public interest to be vacated; and, be it

 

Further Resolved, That as provided by Section 80.32(4) of the Wisconsin Statutes, such vacation shall not terminate the easements and rights incidental thereto acquired by or belonging to any county, town, village or city, or to any utility or person in any underground structures, improvements or services, as enumerated or otherwise existing in said street and in said description of land above described, both easements and rights and all rights of entrance, maintenance, construction and repair with reference thereto shall continue as if such street had not been vacated; and, be it

 

Further Resolved, That the Commissioner of the Department of Public Works be directed, within two months from the date of the adoption of this resolution, to view the aforesaid portion of said street vacated, and assess the benefits and damages accruing or arising from said vacation, and to make his report of his assessment of such benefits and damages to the Common Council of the City of Milwaukee.
