Title
Resolution directing the Commissioner of Public Works to execute a document titled “3rd Revision State/Municipal Agreement for a State-Let Highway Project” with the Wisconsin Department of Transportation for the programming, design, and real estate acquisition of Chase Avenue (STH 38) Bridge over the Union Pacific Railroad with a total estimated cost increase for the project of $3,118,500, with an estimated Grantor share of $2,838,000, and an estimated increase of City share of $280,500.
Analysis
This resolution directs the Commissioner of Public Works to execute a State/Municipal Agreement with the Wisconsin Department of Transportation for the programming, design, and real estate acquisition of Chase Avenue (STH 38) Bridge over the Union Pacific Railroad. The State/Municipal Agreement provides for 75 percent Federal and State aid and 25 percent local cost sharing for preliminary engineering. The State/Municipal Agreement provides for 100 percent Federal and State Aid for real estate acquisition. The total estimated cost of this projects is $9,393,750 with an estimated City share of $556,750 and a grantor share of $8,837,000.
Construction funds for this project will be included in future resolutions.

Whereas, A project agreement has been requested and received from the Wisconsin Department of Transportation (WisDOT) to be executed by the City of Milwaukee for the programming, design, and real estate acquisition of Chase Avenue (STH 38) Bridge over the Union Pacific Railroad (UPRR) with Federal Aid under the State Highway Rehabilitation Program (SHRM); and
Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee of project cost overruns and changes in scope approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City of Milwaukee may be 100 percent liable for project cost overruns and changes in scope as approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City of Milwaukee may be liable for any cost incurred by the State should the City decide to withdraw from the project; and
Whereas, Construction funds for the project will be included in a separate resolution; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is hereby authorized to execute the agreement for the programming, design, and real estate acquisition of the aforementioned SHRM project with Federal and State aid, copies of which are attached to Common Council Resolution File Number 250503, and are incorporated into this resolution by reference as though set forth in full; and, be it
Further Resolved, That the Commissioner of Public Works is hereby authorized to undertake or engage a consultant to undertake preliminary engineering and real estate acquisition for the improvement of the aforementioned project and to reimburse the WisDOT for preliminary engineering and real estate costs they incur from the improvement; and, be it
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project Grant Chart field Values for design engineering for the project (Expenditure) and transfer to any of these accounts the amount required under the grant agreement and City Accounting Policy but not to exceed a 10 percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:
