Title

Resolution approving the acquisition of parts of property at 260 North 12th Street and 825R and 901R West Hinman Street in the Menomonee River Valley “J” Redevelopment Project Area by the Redevelopment Authority of the City of Milwaukee, in the 4th Aldermanic District.

Analysis

Adoption of this resolution will authorize the Redevelopment Authority to acquire property in a redevelopment project boundary. This file has no fiscal impact.

Body

Whereas, By adoption of File No. 892070 on November 1, 1988, the Common Council of the City of Milwaukee (“Council”) approved the boundaries for the Menomonee River Valley “J” Redevelopment Project Area, but a plan has not been prepared; and

Whereas, The Wisconsin Department of Transportation (“WISDOT”) owns three properties in the project boundary at 260 North 12th Street and 825R and 901R West Hinman Street, as a result of property acquisitions for the Marquette Interchange reconstruction, and has offered to convey portions of the properties to the Redevelopment Authority of the City of Milwaukee (“Authority”) now that highway reconstruction has been completed; and

Whereas, A Certified Survey Map (“CSM”) is currently being prepared to reconfigure the site into three parcels of which one will be retained by WISDOT for the I-94/I-43 High Rise Bridge and two parcels will be surplus to WISDOT needs and will be conveyed to the Authority; and

Whereas, Acquisition of these properties by the Authority will ensure that the properties are developed in a manner compatible with the Menomonee Valley Plan that was adopted by the Council as an element of the City’s Comprehensive Plan; and

Whereas, On September 16, 2010, the Authority approved a Reciprocal Easement Agreement with WISDOT that provides for the Authority to acquire the portions of the current properties that will be indentified as Lot 1 and Lot 3 of a future CSM and that provides easements to both parties for access to the respective properties; and

Whereas, The consideration for property acquisition involved the Authority allowing WISDOT to dispose of soil displaced from the Marquette Interchange reconstruction at the Authority’s property in the Menomonee Valley rather than monetary payment from the Authority or the City of Milwaukee; and

Whereas, Section 66.1333.5.(b)4., Wisconsin Statutes, allows the Authority to acquire property in a redevelopment project boundary contingent on approval of the acquisition by the Council; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Redevelopment Authority of the City of Milwaukee is authorized to acquire portions of the following properties in the Menomonee River Valley “J” Redevelopment Project Area:

Part 260 North 12th Street/Tax Key No. 398-0409-121

Part 825R West Hinman Street/Tax Key No. 361-1615-110

Part 901R West Hinman Street/Tax Key No. 361-1615-120

; and, be it

Further Resolved, That after acquisition, the Authority shall market the properties in a manner consistent with the Menomonee Valley Comprehensive Plan.
